<br />B..~ <br />,v <br /> <br />e - <br /> <br />.. <br /> <br />ORDINANCE NO. 1299 <br /> <br />AN ORDINANCE CALLING AN ELECTION OF THE CITY OF LA PORTE, TO BE <br />HELD APRIL 3, 1982, FOR THE ELECTORS OF THE CITY OF LA PORTE, <br />TEXAS, TO LEGALIZE BINGO GAMES FOR CHARITABLE PURPOSES AS AUTHOR- <br />IZED BY THE TEXAS BINGO ENABLING ACT IN THE CITY OF LA PORTE; <br />DESIGNATING ELECTION PRECINCTS AND POLLING PLACES; PROVIDING <br />FOR THE USE OF VOTING MACHINES; APPOINTING ELECTION OFFICIALS; <br />PROVIDING FOR METHOD AND DATES OF ABSENTEE VOTING; PROVIDING <br />FOR RETURN AND CANVASS OF VOTES OF SAID ELECTION; PROVIDING <br />FOR NOTICE; PROVIDING FOR THE HOLDING OF A JOINT ELECTION WITH <br />THE LA PORTE INDEPENDENT SCHOOL DISTRICT; PROVIDING A SAVINGS <br />CLAUSE; FINDING COMPLIANCE WITH THE OPEN MEETINGS LAW; AND <br />PROVIDING AN EFFECTIVE DATE HEREOF. <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LA PORTE: <br /> <br />~ <br /> <br />Section 1. The City Council of the City of La Porte, <br /> <br />pursuant to the terms of the Texas Bingo Enabling Act, hereby <br /> <br />finds, determines and declares that: <br /> <br />(1) Petitions bearing the signatures of more than 150 <br /> <br />153) qualified voters of the City of La Porte have been <br /> <br />filed with the City Secretary of the City of La Porte. <br />( 2) Said number of reg istered voters is a number equal <br /> <br />to or greater than ten per cent (10%) of the number of votes <br /> <br />cast for governor by qualified voters of the City of La Porte in <br />the 1980 general election, or the amount specified in the Home <br /> <br />. <br /> <br />Rule Charter of the City of La Porte, being the document govern- <br />ing the administration of the Ci ty of La Porte, whichever is <br /> <br />less. <br /> <br />( 3) The Ci ty Secretary of the Ci ty of La Porte has veri- <br /> <br />fied said petitions, in accordance with Sec. 6, Texas Bingo <br /> <br />Enabling Act. <br /> <br />(4) Said petitions called for an election to be held at <br /> <br />which the bal10t shall be prepared to prepare for voting for <br /> <br />or against the proposition: "Legalizing bingo games for chari- <br /> <br />table purposes as authorized by Bingo Enabling Act in the City <br /> <br />of La Porte." <br /> <br />~ <br /> <br />(5) The Ci ty Secretary of the Ci ty of La Porte has cer- <br /> <br />tified that said petitions are valid. <br />
