<br />'. <br /> <br />. <br /> <br />ORDINANCE NO. 1441 <br /> <br />AN ORDINANCE AMENDING CHAPTER 26, ARTICLE II, "WATER, SEWERS AND <br />SEWAGE DISPOSAL," SECTION 26-15, OF THE CODE OF ORDINANCES OF <br />THE CITY OF LA PORTE; ESTABLISHING A NEW SEWER RATE AND SEWER <br />FEE STRUCTURE; CONTAINING A SEVERABILITY CLAUSE; FINDING COM- <br />PLIANCE WITH THE OPEN MEETINGS LAW; AND PROVIDING AN EFFECTIVE <br />DATE HEREOF. <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LA PORTE: <br /> <br />Section l. Sec. 26-15, "Sewer Service Charges," of Article <br /> <br />II, Chapter 26, of the Code of Ordinances of the City of La <br /> <br />Porte is hereby amended, to hereafter read as follows, to-wit: <br /> <br />IISec. 26-15 - Sewer Service Charges: <br /> <br />(l) Each single-family dwelling unit individually metered for <br />the consumption of water shall be charged for sanitary <br />sewer service a basic monthly charge of $4.25, plus 70% <br />of the II net" water bill; provided, however, for meter <br />readings from June 1st, through September 30, each single- <br />family dwelling unit individually metered for the consump- <br />tion of water shall be charged for sanitary sewer service, <br />a basic monthly charg e of $4.25, plus 70% of the "net" <br />water bill, but there shall be no charge for sanitary <br />sewer service for that portion of the "net" water bill in <br />excess of Ten Thousand (10,000) gallons; <br /> <br />(2) Commercial connections (except swimming pools owned by non- <br />profit homeowner associations) shall pay for sanitary sewer <br />service at the same rates as single-family dwellings, but <br />shall not be entitled to the Ten Thousand (10,000) gallons <br />maximum as provided for single-family dwelling units; <br /> <br />(3) The monthly sewer service charge for duplex units, apartment <br />units and individual mobile home units in mobile home parks, <br />with units not individually metered for water, will be <br />determined by multiplying the rate of $4.25 times the number <br />of individually constructed duplex or apartment units, or <br />times the number of existing mobile homes in the proj ect, <br />plus 70 percent (70%) of the total "net" water bill for the <br />current month; provided, however for meter readings from <br />June 1st through September 30, each duplex unit, apartment <br />unit, and each individual mobile home not individually <br />metered for the consumption of water shall be charged for <br />sanitary sewer service, a basic monthly charge of $4.25, <br />plus 70 percent (70%) of the "net" water bill, but there <br />shall be no charge for sanitary sewer service for that <br />portion of the "net" water bill in excess of Ten Thousand <br />(10,000) gallons multiplied times the number of duplex <br />units, apartment units, or existing mobile homes. <br /> <br />Section 2. The City Council officially finds, determines, <br /> <br />recites and declares that a sufficient written notice of the <br /> <br />date, hour, place and subject of this meeting of the City Council <br />
