<br />-29- <br />Enclosure 4 to Appendix D is placed upon the face of the <br />Amending Plat and; <br />C. Commission approval of said Amending Plat is reflected by <br />Commission execution of said certificate. <br /> <br />. <br /> <br />. <br /> <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br /> <br />4.07 REPLATTING RECORDED SUBDIVISION PLATS <br />A replat or re-subdivision of. a recorded Subdivision Plat, or <br />a portion thereof, but without vacation of the immediate <br />prev ious plat, is hereby expressly authoriz ed to be record ed <br />and shall be deemed valid and controlling when: <br /> <br />A. It has been signed and acknowledged by only the owners <br />of the particular property which is being replatted or <br />re-subdivided on the acknowledgment shown in Enclosure 1 <br />to Appendix D; <br />B. It does not attempt to alter, amend or remove any covenants <br />and restrictions; <br />C. There is compliance, when applicable, with Subsection (c) <br />and (d) of Section 5, Article 974a, V.T.C.S.; <br />D. It has been approved by the Commission after being prepared <br />and filed as though it were an original plat as specified <br />in Section 4.04 of this Ordinance; and <br />E. All expenses incurred by the City or the subdivider in the <br />Replat process shall be borne by the subdivider, including <br />costs of notice at public hearing. <br />
