<br />. <br /> <br />. <br /> <br />FOREWARD <br /> <br />On December 12, 1988, the City of La Porte, by Ordinance 1626 (See <br />Exhibit A), annexed the former Bayshore Municipal Utility District <br />(BayMUD). This annexation became effective at 12:01 A.M., December <br />31, 1988. As required by City Zoning Ordinance 1501, a temporary <br />classification of R-1, Low Density Residential Zoning was assigned to <br />all property wi thin the annexed area. In order to comply with the <br />requirements of both the Zoning Ordinance and State law, the City must <br />assign permanent zoning classifications to all property located within <br />the annexed area by a date, no later than 180 days following the <br />effective date of annexation. This date is June 28, 1989. <br />The assignment of zoning classifications cannot be made on an <br />arbitrary basis, nor can they be based solely on existing patterns of <br />land use. Zoning must rather, be based upon the Comprehensive Plan of <br />the City of La Porte. Integrat ion of a newly annexed area into the <br />goals of the Comprehensive Plan is therefore the first prerequisite <br />for assigning permanent zoning to any newly annexed area. <br />At this point, it is appropriate to examine the relationship of <br />the City's Comprehensive Plan to the Zoning Ordinance. This can best <br />be done by a quoting from Article One of Ordinance #1501. <br />
