<br />e <br /> <br />e <br /> <br />-67- <br /> <br />use permit may be rescinded by the City Council, upon its own <br />motion or upon the recommendation of the Planning and Zoning <br />Commission of the City of La Porte, and the previous zoning <br />of the entire tract shall be .in full effect on the portion <br />which is undeveloped. <br /> <br />5. Every special conditional use permit granted as provided' herein <br />shall be considered as an amendment to the Zoning Ordinance as <br />applicable to such property. <br /> <br />10'- 202 Conditions for Aooroval. A Soecial Conditional Use Permit <br />shall be issued onlv if all of th~ following conditions <br />have been found. <br /> <br />1. That the specific use will be compatible with and not injurious <br />to the use and enjoyment of other property, nor significantly <br />diminish or impair property values within the immediate vicinity. <br /> <br />2. That the conditions placed on such use as specified in each <br />district have been met by the applicant. <br /> <br />3. That the applicant has agreed to meet any additional conditions <br />imposed, based on specific site constraints, and necessary to <br />protect the pUblic interest and welfare of the community. <br /> <br />10 - 203 Amendments <br /> <br />The procedure for amendments for a Special Conditional Use Permit <br />shall be the same as for a new application. <br /> <br />10 - 300 Accessorv Buildings, Uses and Eauioment <br /> <br />1. No accessory buildings, uses or structures shall be erected or <br />located in any required yard other than the rear yard except: <br /> <br />A detached private garage, or carport, as defined, may be <br />permitted in side yards, provided: (1) they comply with all <br />the requirements of this section; (2) they shall be five feet <br />(5') or more from side lot lines; and (3) the side yard does <br />not abut a street right-of-way. <br /> <br />..... <br /> <br />Accessory Buildings built on a skid foundation, no larger than <br />one hundred twenty (120) square feet and no more than one story <br />in height may be located in utility easements in required rear <br />yards, except that they may not be located closer than three <br />feet (3') from a side or rear property line or closer than six <br />feet (6') from any other structure. <br />
