' <br /> <br />Section 5 - 201 Footnote 3 -- Both the greenbelt area itself and the-20' <br />landscaped setback along the public green\vay corridors are equivalent to <br />city park land and therefore should be purchased by the city fran the <br />land Ql'mer and maintained by the ci ty. There is no definition 'of <br />parkways in the Zoning Ordinance. However, is the city desires to <br />inprove its parkways (thoroughfares), then the city should purchase such <br />land area fran land owners and landscape and maintain such areas at city <br />expense. Therefore, we recoomend that Footnote 3 be deleted fran the <br />Zoning Ordinance. <br /> <br />Section 5 - 800 Subparagraph -- This section is so broad that it would <br />be nearly inpossible to enforce it fairly in regard to all property <br />owners, especially as the section pertains not only to existing <br />surrounding uses but future surrounding uses (whi ch are inpossible to <br />determine now). Further this section does not state who would be <br />responsible for deciding the "carpat ibi li ty". Therefore we recmmend <br />that this section be deleted fran the Zoning Ordinance because other <br />provisions of the Ordinance adequately provide for the goal that this <br />section is trying to achieve. <br /> <br />a:I\MN.rs CN ARTICLE 6 <br /> <br />Section 6 - 500 -- Under the maxinun height. neighborhood coomercial <br />heights should be increased to 45'. <br /> <br />Section 6 - 501 Footnote I -- Footnote I should be revised to require <br />the City of La Porte to purchase both greenbelt areas and any landscape <br />setback areas lying adjacent to public greenway corridors fram the land <br />owner for the city to maintain as public park areas. Par~vay corridors <br />is not defined in this ordinance, however, if the city wishes to <br />landscape city thoroughfares the city should purchase such land area <br />fran land owners and landscape and maintain the area at the ci ty expense <br />;as ,public park. areas. . Therefore we recoomend that Footnote 1 under <br />Section 6 - 501 be deleted fran the OTdinance or revised to reflect that <br />the city wi II purchase and maintain such 20' landscape setbacks and <br />greenbelt corridor areas. <br /> <br />Section 6 - 501 Footnote 3 -- Parking should be allowed in coomercial <br />yard setbacks. Further, this additional thoroughfare setback is <br />unnecessary and should be deleted. <br /> <br />,Section 6 - 600 ,Subparagraph B4 -- Lighting which is covered by a glass <br />globe should be allowed in such commercial areas. <br /> <br />Sect ion 6 - 600 Subparagraph B5 -- I f the area has the requi red <br />screening, then the 5' setbacks are an unreasonable restriction on the <br /> <br />\ft <br />
