<br />e <br /> <br />. <br /> <br />ORDINANCE NO. 96-197&~A <br /> <br />AN ORDINANCE AME~DING ORDINANCE NO. 94-1976, WHICH GOVERNS THE RENTAL <br />FEE POLICY AND SCHEDULE FOR THE LA PORTE LIVESTOCK/RODEO ARENA; <br />FINDING COMPLIANCE WITH THE OPEN MEETINGS LAW; AND PROVIDING AN <br />EFFECTIVE DATE HEREOF. <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LA PORTE: <br />Section 1. That Section Four and Section Five of Ordinance No. 94-1976 shall be amended <br />to hereafter read as follows, to-wit: <br />"Section 4. Reservations for the use of the Arena may be made, after January 15th, for <br />each current calendar year either by phone or in person at the Parks and Recreation <br />Administration office or any other place that may be designated from time to time. <br />Reservations must be accompanied by a Reservation and Damage Deposit (Deposit) <br />of $100.00. The Deposit must be received by the Parks and Recreation Administration <br />office by close of business of the second business day after the day the reservation was <br />made. The Deposit will reserve the facility for the Lessee until rental payments are <br />made and will apply toward any damage to the Arena caused by the Lessee. The <br />Deposit will be refunded to the Lessee within fifteen (15) days after the event, less any <br />deductions for damages incurred. The maximum Deposit amount for anyone individual <br />or organized group for multiple reservations shall be $100.00, unless the individual or <br />organized group cancels two (2) reservations in a calendar year. If the individual or <br />organized group cancels two (2) reservations in a calendar year, they will then be <br />required to post an additional $100.00 Deposit for each reservation made for the <br />remainder of the calendar year in which the cancellations were made. If reservation is <br />made with less than two (2) weeks notice, rental fee and deposit are due by close of <br />business of the next business day, and must be paid in cash, cashier's check, or money <br />order. <br />Section 5. For rental dates that are canceled, the Lessee shall provide written notice <br />of the cancellation to the City at least two (2) weeks prior to reservation date in order to <br />receive a full refund. Reserved dates that are canceled less than two weeks prior to the <br />event, will result in forfeiture of the Deposit for that date, and no refund of rental fees <br />shall be given. Rental fees may be applied to another date, pending availability." <br />
