<br />. <br /> <br />e <br /> <br />any Signatory may raise any of the following reserved issues relating to the calculation of the STP <br /> <br />Deferrals: <br /> <br />AFUDC (Carrying Cost) Rate Differences <br />Depreciation Rate Differences <br />Balance Subject to Carrying Costs Reduced Monthly <br />by Accumulated Depreciation <br />Balance Subject to Carrying Costs Reduced Monthly by ADm <br />Balance Subject to Carrying Costs Reduced Monthly by Bonded Rates <br />Effect of STP-l Accounting Deferral Differences <br />on STP-l Qualified Defemls <br />Combined Effects of the Calculation Differences <br />In earnings monitoring evaluations or Section 42 proceedings. the parties are not limited as to the <br />methodology they may use when calculating the reserved issues. <br />In exchange for the mutual consideration that is being exchanged through this <br />Agreement, except for the right to propose adjustments associated with the reserved issues (which <br />adjustments to STP Deferrals balances may not exceed $88 million), no Signatory may contest <br />inclusion of the STP Deferrals in rate base or contest amortization of STP Defemls as an <br />operating expense in cost of service in any Section 42 proceeding or earnings monitoring <br />evaluation during the Rate Cap Period. <br />Except as provided in paragraphs B and C of this Article X, the position on the <br />STP Deferrals that parties are obligated to take as a result of this Agreement is without prejudice <br /> <br />HOUOJ:911046 <br /> <br />-23- <br />
