<br />e <br /> <br />e <br /> <br />consideration granted by any Signatory shall be made known immediately to all Signatories: and <br /> <br /> <br />any Signatory may in that Signatory's discretion freely withdraw from this Agreement and request <br /> <br /> <br />reopening of hearings on the merits of the settlement. The terms of this anicle will also be <br /> <br /> <br />applicable to Pending Appeals of past Commission proceedings involving HL&P, including <br /> <br />appeals related to Commission Docket Nos. 8230/9010,6668. 8425,9850 and 10092. The above <br /> <br /> <br />provisions notwithstanding, if HL&P voluntarily or by order of the Commission reimburses a <br /> <br />municipality for reasonable expenses incurred in participating in either Docket Nos. 12065 or <br /> <br />13126 or any appeals of Commission rate proceedings, then such reimbursement shall be made <br /> <br />known to all Signatories but shall not permit any Signatory to withdraw from this Agreement. <br /> <br />This Article was agreed to by the Signatories as pan of the overall consideration for other <br /> <br /> <br />provisions of this Agreement. It is based upon the unique conditions underlying this Agreement. <br /> <br /> <br />Its inclusion in this Agreement shall not be cited by any entity as a recognition that the provisions <br /> <br /> <br />of this paragraph would be appropriate or that these provisions are more appropriate than other <br /> <br /> <br />types of disclosure or preferential tteaanent provisions in any other proceeding involving the same <br /> <br />or different parties. <br /> <br />ARTICLE XX. <br /> <br />Other Provisions <br /> <br />A. The Signatories after extensive negotiations have reached a compromise and <br /> <br />settlement to resolve Docket No. 12065, Docket No. 13126 as it relates to HL&P and Section 42 <br /> <br />proceedings initiated by municipalities with regulatory jurisdiction over HlAP's rates and other <br /> <br />matters discussed herein.
