<br />. <br /> <br />. <br /> <br />ORDINANCE NO. 95- 2063 <br /> <br />AN ORDINANCE ELECTING TO HAVE THE PROVISIONS OF CHAPTER 252, <br />"PURCHASING AND CONTRACTING AUTHORITY OF MUNICIPALITIES," OF THE <br />TEXAS LOCAL GOVERNMENT CODE SUPERSEDE THE PROVISIONS OF THE HOME <br />RULE CHARTER OF THE CITY OF LA PORTE; FINDING COMPLIANCE WITH THE <br />OPEN MEETINGS LAW; PROVIDING AN EFFECTIVE DATE HEREOF. <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LA PORTE: <br /> <br />Section 1. <br /> <br />The City Council of the City of La Porte, the <br /> <br />governing body of the City of La Porte, hereby elects to have the <br /> <br />provisions of Chapter 2S2, "Purchasing and Contracting Authority of <br /> <br />Municipalities," Texas Local Government Code, supersede the <br /> <br />provisions of the Home Rule Charter of the City of La Porte that <br /> <br />relates to the notice of contracts, advertisement of the notice, <br /> <br />requirements for the taking of sealed bids based on specifications <br />for public improvements or purchases, the manner of publicly <br />opening bids or reading them aloud, or the manner of letting <br />contracts that are in conflict with Chapter 2S2, Texas Local <br /> <br />Government Code. <br /> <br />Section 2 . <br /> <br />This Ordinance is enacted pursuant to the <br /> <br />authority contained in S2S2.002, Texas Local Government Code, and <br /> <br />S5.02, "Purchase Procedure," of the Home Rule Charter of the City <br /> <br />~ <br /> <br />of La Porte, as amended on May 5, 1990. <br /> <br />Section 30 <br /> <br />The City Council officially finds, determines, <br /> <br />recites, and declares that a sufficient written notice of the date, <br /> <br />hour, place and subject of this meeting of the City Council was <br />posted at a place convenient to the public at the City Hall of the <br />ci ty for the time required by law preceding this meeting, as <br />required by the Open Meetings Law, Chapter SSl, Texas Government <br />Code; and that this meeting has been open to the public as required <br />
