<br />e <br /> <br />e <br /> <br />An applicant who is denied a taxicab permit shall have the right to appeal to the <br />City Council within ten (10) days from the date of denial of the permit. The appeal shall <br />be perfected by a letter address to the City Secretary stating than an appeal from the <br />decision of the City of La Porte is desired. City Council, as soon a practicable after <br />receiving such notice of appeal from the findings of the City, and after hearing on such <br />appeal, shall sustain, modify, or reverse the findings made by the City and shall notify the <br />Applicant of its findings. Findings of the City Council shall be final. <br /> <br />Sec. 2.5 Fee for taxicab permit <br /> <br />(a) The fee for a taxicab permit issued by the City of La Porte shall be $100.00 <br />per annum for each taxicab licensed. Such fees shall be collected by the City Secretary <br />prior to the issuance of the taxicab permit. Permits issued are issued on a calendar year <br />basis, becoming effective January 1 of the year in which issued, and continuing in effect <br />until December 31 of said licensed year, unless revoked as provided in this article. If an <br />applicant for a taxicab permit seeks a permit in the middle of a calendar year, said permit, <br />within and if issued, shall be effective from the date of issuance until December 31 of the <br />calendar year in which the permit is issued. The fee for said taxicab permit issued during <br />a calendar year shall be pro-rated. <br /> <br />(b) Failure of an owner to pay the permit fee shall render the permit canceled <br />immediately, without further notice to the permit holder. Payment of any of the fees <br />required under the terms hereof shall not bar a prosecution for violations of the terms of <br />this article. <br /> <br />Sec. 2.6 Temporary vehicle permits. <br /> <br />Whenever a taxicab shall become inoperative, the owner may apply to the City <br />Secretary or his duly designated representative, for a temporary permit to operate another <br />vehicle during the time that the authorized taxicab shall remain inoperative. The City <br />Secretary or his duly designated representative, upon the presentation of the application <br />and a certificate evidencing an inspection of the vehicle, as well as the vehicle's <br />compliance with all applicable provisions of this article, shall issue a temporary permit for <br />any period not to exceed thirty (30) days. All other provisions of this code relate to the <br />operation of taxis operating under temporary permits, as well as annual permits. <br /> <br />Sec. 2.7 Assignment. <br /> <br />No permit issued under the provisions of this article shall be sold, assigned, <br />transferred, pledged or let without the written approval of the City Secretary or his duly <br />designated representative, and then only upon a showing that the transferee, assignee, <br />or buyer is in full compliance with the provisions of this article. In no event shall a permit <br />be sold, assigned, transferred, pledged or let except upon full compliance by the <br />purchaser with the terms of this article. <br /> <br />Sec.2.8 Expiration and revocation. <br /> <br />It is the duty of the holder of any permit issued under this Article to keep said <br />permit current, and likewise to keep application required in section 2.3 current. Failure of <br />the owner of a taxicab for which a permit has been issued to use the vehicle for a period <br />in excess of sixty (60) days shall automatically render the same null and void.
