<br />Ordinance No. 99- <br />Page 2 <br /> <br />2. <br /> <br />e <br /> <br />(c) It shall be unlawful for the minor or any other person to solicit, <br />accept or agree to accept any cash, benefit or other thing of monetary value <br />from any person for the privilege of dancing with a minor. <br /> <br />(d) The provisions of this section shall apply without regard to <br />whether (1) the minor is an employee, agent or contractor of the public <br />dance hall or is merely present in the public dance hall; (2) the cash, benefit <br />or other thing of monetary value is solicited or accepted by the licensee or <br />operator, the minor or any other person; and (3) the cash, benefit or other <br />thing of monetary value is solicited or accepted exclusively for the dancing <br />privilege or for food, beverage or other services or merchandise with which <br />the dancing privilege is also provided." <br /> <br />Section 2. That violations of Sections 90-80 or 90-81 of the Code of Ordinances, <br /> <br />La Porte, Texas, as adopted in Section 1 of this Ordinance, are punishable by a fine of up <br /> <br />to Five Hundred Dollars ($500.00) as provided in Appendix B - Fines of the Code of <br /> <br />. <br /> <br />Ordinances of the City of La Porte. <br /> <br />Section 3. That, if any provision, section, subsection, sentence, clause, or phrase <br /> <br />of this Ordinance, or the application of same to any person or set of circumstances is for <br /> <br />any reason held to be unconstitutional, void or invalid, the validity of the remaining <br /> <br />portions of this Ordinance or their application to other persons or sets of circumstances <br /> <br />shall not be affected thereby, it being the intent of the City Council in adopting this <br /> <br />Ordinance that no portion hereof or provision or regulation contained herein shall become <br /> <br />inoperative or fail by reason of any unconstitution-ality, voidness or invalidity of any other <br /> <br />portion hereof, and all provisions of this Ordinance are declared to be severable for that <br /> <br />purpose. <br /> <br />Section 4. The City Council officially finds, determines, recites, and declares that <br /> <br />a sufficient written notice of the date, hour, place and subject of this meeting of the City <br /> <br />Council was posted at a place convenient to the public at the City Hall of the City for the <br />
