<br />e <br /> <br />e <br /> <br />1.2 Operator shall not provide any type of telecommunication, two <br />way audio and video, to any properties other than those <br />described in section 1.1 within the boundaries of City unless <br />Operator first secures a franchise from City for such purpose. <br /> <br />2. OPERATOR'S ADDITIONAL LIMITATIONS. <br /> <br />In addition to the conditions contained herein, Operator shall <br />comply with and be subject to the same limitations on the use <br />of City public rights-of-way as the public utility operator(s) <br />in whose conduit or upon whose poles Operator is authorized <br />hereunder to place and erect its fiber optic cable. Operator <br />further agrees to apply for and receive from the City a permit <br />prior to beginning any work under this Agreement, which permit <br />authorizes the excavation, construction, laying of duct or <br />cable, or any other work authorized under this Agreement. <br /> <br />3. CITY'S RESPONSIBILITIES. <br /> <br />City shall, during the term of this Agreement, allow Operator <br />access, use, and occupancy of the public rights-of-way <br />described in section 1.1 above, as is reasonably necessary and <br />convenient for Operator to route its cable. <br /> <br />4. TERM OF AGREEMENT. <br /> <br />4.1 This Agreement shall continue for an initial term of four (4) <br />years from the date hereof, and shall continue during the term <br />of the agreement between La Porte Independent School District <br />and Phonoscope Fiber Optic Services, Ltd., unless sooner <br />terminated pursuant to the provisions of this Agreement. <br /> <br />4.2 RENEWAL. At the end of the initial term, this Limited Use <br />License Agreement may be renewed by mutual agreement of all <br />parties. <br /> <br />4.3 REMOVAL OF EQUIPMENT. Upon termination of this Agreement for <br />any reason, including cancellation of the contracts for <br />services between Operator and District and/or City, Operator <br />shall, within a reasonable time, not to exceed one-hundred and <br />twenty (120) days, remove all cable and equipment installed <br />within City, at its expense. Operator shall restore the <br />property to the condition of such premises prior to the <br />installation of cable and equipment, reasonable wear and tear <br />and casualty damage excepted. <br /> <br />5. NOTICE. <br /> <br />5.1 All written notices or requests provided hereunder, as well as <br />all other communications related to this Agreement, shall be <br />in writing and shall be deemed to have been duly given if <br />personally delivered or if mailed, by registered overnight or <br />certified mail, return receipt requested, as follows: <br /> <br />2 <br />
