<br />e <br /> <br />e <br /> <br />~@U~iJ\l'/ <br /> <br />"Personal Property" means Owner's furniture, fiV~l::l...C1OO, TVL <br />computer equipment, radio equipment, mobile machinery, <br />miscellaneous machinery and equipment, supplies, inventory, work in <br />process, finished goods and raw materials, as described on Exhibit <br />"D", HCAD Account No. 0173299. <br /> <br />"Project" means the facility to be used by the Owner on the <br />Real Property as more fully described in section 5(c) below. <br /> <br />"Real Property" means the real property of the Owner to be <br />improved, as more fully described in Section J(a) below. <br /> <br />"Tax Code" means the Texas Property Tax Code, as amended. <br /> <br />"Zone" means PPG Industries Reinvestment Zone, which is more <br />particularly described on Exhibits "D" and "E" of the Ordinance. <br /> <br />2. Authorization <br /> <br />This Agreement is authorized by Article V, Sections 66-140 <br />through 66-152, of the La Porte Code of Ordinances and by the <br />Ordinance. <br /> <br />3 . PrODertv <br /> <br />(a) The street address of the taxable real property to be <br />improved under this Agreement is 1901 Avenue "H" at South 16th <br />street, La Porte, Texas. The Real Property is described more fully <br />on Exhibit "A" and Exhibit "B" attached hereto and made a part <br />hereof for all purposes. <br /> <br />(b) The street address of the Abated Property to be installed <br />under this Agreement is 1901 Avenue "H" at South 16th Street, La <br />Porte, Texas. The Abated Property is described more fully on <br />Exhibit "C" attached hereto and made a part hereof for all <br />purposes. <br /> <br />(c) The HCAD tax account numbers of the Real Property and the <br />Personal Property are as shown on Exhibit "0" attached hereto and <br />made a part hereof for all purposes. <br /> <br />4. ReDresentations and Warranties bv the OWner <br /> <br />(a) The Owner represents that it owns the Real Property and <br />the Real Property is located within the boundaries of the Zone. <br />The Owner represents that it is authorized to execute this <br />Agreement and to complete the Improvements described in section 5 <br />hereof and on Exhibit "c" attached hereto. The Owner represents <br />that as of January 1, 1998, the Real Property had an existing <br />incinerator and two storage sheds (all of which will be demolished <br />prior to the new construction). The owner represents and warrants <br />that construction of the Improvements described on Exhibit "C" will <br />begin qn or after October 1, 1998, and that construction of the <br />Improvements will not have commenced on or before the effective <br />date of this Agreement.
