<br />e <br /> <br />e <br /> <br />rules, and regulations of the state and federal governments and any administrative agencies thereof. <br /> <br />If any such state or federal law, rule or regulation shall require or permit the Grantee to perform any <br /> <br /> <br />service or shall prohibit the Grantee from performing any service in conflict with the provisions of <br /> <br /> <br />this Franchise, the Grantee shall notify the Director in writing of the point of conflict believed to <br /> <br /> <br />exist between such state or federal law, rule, or regulation and this Franchise, at such time as the <br /> <br /> <br />conflict affects the performance ofthe Grantee under this Franchise. <br /> <br /> <br />Section 17. MODIFICATIONS BY FCC. To the extent that any rules and regulations <br /> <br /> <br />adopted by the FCC conflict with the terms of this Franchise, it is specifically agreed by the City <br /> <br />and Grantee that this Franchise shall be deemed to be modified in accordance with such rules and <br /> <br />regulations. Should the FCC lose or voluntarily abdicate regulatory jurisdiction over any aspect of <br /> <br />cable television, the City shall be empowered to assume regulatory jurisdiction over any such <br /> <br />deregulated aspects, provided that the City's regulation is not unreasonable or contrary to local, <br /> <br />state or federal law . <br /> <br />Section 18. CONDITIONS OF STREET OCCUPANCY. <br /> <br /> <br />1. Use. All structures, wires, cables, equipment and facilities erected or maintained by <br /> <br /> <br />the Grantee within the City shall be located so as to cause minimum interference with the proper <br /> <br />and intended use of the Streets and with the rights or reasonable convenience of the owners or <br /> <br /> <br />occupants of property which adjoins any of such Streets. <br /> <br />2. Restoration. The surface of any Street disturbed by the Grantee in laying, <br /> <br /> <br />constructing, maintaining, operating, using, extending, removing, replacing or repairing the Cable <br /> <br /> <br />System shall be restored by the Grantee at each occurrence immediately after the completion of the <br /> <br /> <br />work, at its cost and expense, to a condition better or reasonably comparable to that in existence <br /> <br />before the commencement of the work and maintained by the Grantee to the satisfaction of the <br /> <br />17 <br />
