<br />e <br /> <br />-- <br /> <br />discounts, such as rate reductions for senior citizen or low-income Subscribers, within the City of <br /> <br />South Houston, the City of Pasadena, the City of Deer Park, the City of Morgan's Point, or the City <br /> <br /> <br />of Shoreacres, Grantee agrees to offer the same such discount to Subscribers in the City. Nothing <br /> <br /> <br />herein shall require Grantee to offer the same base rates within the communities noted above. <br /> <br /> <br />Furthermore, Grantee shall not required to offer the discount within the City if it is not currently <br /> <br /> <br />available to Subscribers in the above-named communities, but only "grandfathered" as a <br /> <br /> <br />previously-offered discount. Should Grantee offer such a discount in the City, Grantee shall notify <br /> <br /> <br />Subscribers of the discount and the criteria for qualifying for such discount at the implementation <br /> <br /> <br />of such discount, upon installation, upon request, and at least once a year. <br /> <br /> <br />4. Reduction. Rates and charges may be reduced at any time without thirty (30) days <br /> <br /> <br />notice being provided. The Grantee shall, as a courtesy, however, advise the Director at least <br /> <br /> <br />fourteen (14) days prior to the reduction becoming effective when within Grantee's control. When <br /> <br /> <br />temporary reductions are put into effect for promotional purposes for a specified time period, the <br /> <br /> <br />Grantee is not required to provide notice to the City of a rate change. The return to the rates on file <br /> <br /> <br />with the City shall not be considered a rate increase for purposes of this section. <br /> <br /> <br />Section 28. FORCE MAJEURE. Notwithstanding any other provision of this Franchise, <br /> <br />the Grantee shall not be liable for delay in performance of, or failure to perform, in whole or in part, <br /> <br /> <br />its obligations pursuant to this Franchise due to Force Majeure. In the event that any such delay in <br /> <br /> <br />performance or failure to perform affects only part of the Grantee's capacity to perform, the Grantee <br /> <br /> <br />shall perform to the maximum extent it is able to do so and shall take all steps within its power to <br /> <br /> <br />correct the cause(s) of the delay or failure of performance. The Grantee agrees that in correcting <br /> <br /> <br />such cause(s), it shall take all reasonable steps to do so in as expeditious a manner as possible. The <br /> <br /> <br />Grantee shall notify the Director in writing of the occurrence of an event covered by this Section 28 <br /> <br />27 <br />
