<br />e <br /> <br />e <br /> <br />cablecast in accordance with the rules and procedures established by the City. <br /> <br />"Grantee" shall mean Tele-Vue Systems, Inc., a Washington corporation, or any Person <br /> <br />who succeeds Tele-Vue Systems, Inc., in accordance with the provisions of this Franchise. <br /> <br />"Gross Revenues" shall mean all revenues received by the Grantee from operating its Cable <br /> <br /> <br />System to provide Cable Service in the City of La Porte, including, but not limited to, Basic Cable <br /> <br /> <br />Service revenues, Expanded Cable Service revenues, Pay Television revenues, additional Cable <br /> <br /> <br />Service revenues, advertising revenues, franchise fees collected from customers, and leased access <br /> <br /> <br />revenues. Gross Revenues shall not include the following: <br /> <br />1. any taxes which are imposed on any Subscriber or Grantee by any governmental <br /> <br />unit; <br /> <br />2. revenues resulting from the sale of non-addressable Converters or other retail <br /> <br />equipment which is available from sellers other than the Grantee; <br /> <br /> <br />3. revenues from the studio production of programming; or <br /> <br /> <br />4. fees collected by Grantee from Subscribers to be paid to the FCC. <br /> <br /> <br />"Pay Television" shall mean the delivery over the Cable System of programming to <br /> <br /> <br />Subscribers for a fee or charge over and above the charge for Basic Cable Service or Expanded <br /> <br /> <br />Cable Service, on a per-program, per-Channel or other subscription basis. <br /> <br /> <br />"Person" means an individual, partnership, association, joint stock company, trust, <br /> <br /> <br />corporation, or governmental entity. <br /> <br />"Public Access" shall mean non-commercial public programming produced and cablecast in <br /> <br /> <br />accordance with the rules and procedures established by the City. <br /> <br /> <br />"Service Area" shall mean all of the current area within the corporate limits of City, and any <br /> <br /> <br />area hereafter annexed to, or consolidated with, City as provided in Section 5 herein. <br /> <br />5 <br />
