<br />i <br /> <br />T <br /> <br />e <br /> <br />. <br />RESOLUTION NUMBER 80-1 <br /> <br />A RESOLUTION CONCERNING THE APPOINTMENT OF THE BOARD OF <br />DIRECTORS OF THE APPRAISAL DISTRICT OF HARRIS COUNTY, <br />TEXAS. <br /> <br />BY PASSAGE OF THIS RESOLUTION, this governing..b~dy expressly adopts, <br />validates and ratifies all previous actions taken by this body concerning the <br />formation of and the election of the members of the Board of Directors of the . <br />Harris County Tax Appraisal District. <br />I <br />IN THE EVENT that any court should declare that the previous actions I <br />taken by this governing body in the passage of or pursuant to its previous : <br />RESOLUTION CONCERNING THE APPOINTMENT OF THE BOARD OF DIRECTORS OF THE APPRAI- . <br />SAL DISTRICT OF HARRIS COUNTY, TEXAS, this governing body expressly resolves <br />as follows: <br /> <br />WHEREAS, the Legislature of the State of Texas passed and the Gover- <br />nor signed into law Senate Bill 621 (the Property Tax Code) which relates to <br />ad valorem taxation; and <br /> <br />WHEREAS, said Property Tax Code provides for the creation of a <br />central appraisal district within each County of the State; and said Code' <br />further provides that said central appraisal district be governed by a five <br />(5) member board which shall be elected by.the qualified voting taxing units <br />within the County by the following formula as set forth in Section 6.03(d): <br /> <br />u <br />V = T x 1000 x 5 <br /> <br />v = The number of votes to which a taxing unit is entitled. <br /> <br />~ <br /> <br />u = The dollar amount of property taxes imposed by a taxing <br />unit duri~g the preceding tax year. <br /> <br />T = The sum of the total dollar amount of property taxes im- <br />posed in the appraisal district for that year by each <br />taxi~g unit that is entitled to vote. <br /> <br />WHEREAS, Section 6.03(i) of the Property Tax Code provides that a <br />majority of three-forths (3/4) of the qualified voting units within the County <br />may change the number of members of the board or may change the method of" <br />sele~ti~g members of the board; ~nd <br /> <br />WHEREAS, Harris County is a large urban county containing in excess <br />of fifty (50) taxing units, ninety-five {95%} percent of which are small in <br />comparison to taxes levied by a few large units; and <br /> <br />WHEREAS, the board size and method of selecting said board provides <br />in Sect.ions 6.03(a) and (d) would not provide a fair and equitable board under <br />the particular circumstances in Harris County; and <br /> <br />WHEREAS, an expanded number of board members selected under a dif- <br />ferent method would under the part.icular circumstances relevant to Harris <br />County provide a broader and more equitable representation of all of the tax- <br />ing units in Harris County. <br /> <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF <br />WEST UNIVERSITY PLACE, TEXAS: <br /> <br />THAT, under the authority granted by Section 6.03(i} the City of <br />West University Place City Commission hereby elects to proceed with the selec- <br />tion of the board of directors for the 'Harris County Appraisal District as set <br />forth below: <br /> <br />I. The number of directors which shall comprise the Board of Direc- <br />tors of the Harris County Appraisal District shall be nine (9). ' <br /> <br />II. The method of selecting the members of the board of directors <br />shall be as follows: <br />
