",. <br /> <br />e <br /> <br />e <br /> <br />~~:. <br /> <br />, <br /> <br />THE STATE OF TEXAS I <br />I <br />COUNTY OF HARRIS I <br /> <br />RESOLUTION CONCERNING THE APPOINTMENT OF <br />THE BOARD OF DIRECTORS OF THE APPRAISAL <br />DISTRICT OF "HARRIS COUNTY," TEXAS ".. .- <br /> <br />KNOW ALL MEN BY THESE PRESENTS: <br /> <br />RESOLUTION NO. <br /> <br />Iff) -' / <br /> <br />BY PASSAGE OF THIS RESOLUTION, this governing body expressly adopts, <br />validates and ratifies all previous actions taken by this body concerning <br />the formation of and the election of the members of the Board of Directors <br />of the Harris County Tax Appraisal District. <br /> <br />IN THE EVENT that any court should declare that the previous actions <br />taken by this governing body in the passage of or pursuant to its previous <br />RESOLUTION CONCERNING THE APPOINTMENT OF THE BOARD OF DIRECTORS OF THE <br />APPRAISAL DISTRICT OF HARRIS COUNTY, TEXAS, this governing body expressly <br />resolves as follows: <br /> <br />WHEREAS, the Legislature of the State of Texas passed and the Governor <br />signed into law Senate Bill 621 (the Property Tax Code) which relates to <br />ad valorem taxation; and <br /> <br />WHEREAS, said Property Tax Code provides for the creation of a central <br />appraisal district within each County of the State; and said Code further <br />provides that said central appraisal district be governed by a five (5) <br />member board which shall be elected by the qualified voting taxing units <br />within the County by the following formula as set forth in Section 6.03 (d): <br /> <br />V= f x 1000 x 5 <br /> <br />V = The number of votes to which a taxing unit is entitled. <br /> <br />u = The dollar amount of property taxes imposed by a taxing unit <br />during the preceding tax year. <br /> <br />T = The sum of the total dollar amount of property taxes imposed <br />in the appraisal district for that year by each taxing unit that is <br />entitled to vote. <br /> <br />WHEREAS, Section 6.03(i) of the Property Tax Code provides that a <br />majority of three-forths (3/4) of the qualified voting units within the <br />County may change the number of members of the board or may change the method <br />of selecting members of the board; and <br /> <br />WHEREAS, Harris County is a large unban county containing in excess <br />of fifty (50) taxing units, ninety-five (95) percent of which are small <br />in comparison to taxes levied by a few large.units; and <br /> <br />WHEREAS, th~boardsize and method of selecting said board provides in <br />Sections 6.03(a) and (d) would not provide a fair and equitable board under <br />the particular circumstances in Harris County; <br />and <br /> <br />WHEREAS, an~xpanded number of board members selected under a different <br />method would under the particular circumstances relevant to Harris County <br />provide a broader and more equitable representation of all of the taxing <br />units in Harris County. <br />
