<br />e <br /> <br />e <br /> <br />THE STATE OF TEXAS ~ <br />~ <br />COUNTY OF HARRIS ~ <br /> <br />KNOW ALL MEN BY THESE PRESENTS: <br /> <br />RESOLUTION CONCERNING THE APPOINTMENT OF <br />THE BOARD OF DIRECTORS OF THE APPRAISAL <br />DISTRICT OF HARRIS COUNTY, TEXAS <br />RESOLUTION NO. tJ I I ~ ?o <br /> <br />BY PASSAGE OF THIS RESOLUTION, this governing body expressly <br />adopts, validates and ratifies all previous actions taken by this <br />body concerning the formation of and the election of the members <br />of the Board of Directors of the Harris County Tax Appraisal Dis- <br />trict. <br /> <br />IN THE EVENT that any court should declare that the previous <br />actions taken by this governing body in the passage of or pursuant <br />to its previous RESOLUTION CONCERNING THE APPOINTMENT OF THE BOARD <br />OF DIRECTORS OF THE APPRAISAL DISTRICT OF HARRIS COUNTY, TEXAS, <br />this governing body expressly resolves as follows: <br /> <br />WHEREAS, the Legislature of the State of Texas passed and the <br />Governor signed into law Senate Bill 621 (the Property Tax Code) <br />which relates to ad valorem taxation; and <br /> <br />WHEREAS, said Property Tax Code provides for the creation of <br />a central appraisal district within each County of the State; and <br />said Code further provides that said central appraisal district be <br />governed by a five (5) member board which shall be elected by the <br />qualified voting taxing units within the County by the following <br />formula as set forth in Section 6.03(d): <br /> <br />V= ~ x 1000 x 5 <br /> <br />V = The number of votes to which a taxing unit is entitled. <br /> <br />u = The dollar amount of property taxes imposed by a taxing <br />unit during the preceding tax year. <br /> <br />T = The sum of the total dollar amount of property taxes im- <br />posed in the appraisal district for that year by each <br />taxing unit that is entitled to vote. <br /> <br />WHEREAS, Section 6.03(i) of the Property Tax Code provides that <br />a majority of three-forths (3/4) of the qualified voting units within <br />the County may change the number of members of the board or may <br />change the method of selecting members of the board; and <br /> <br />WHEREAS, Harris County is a large urban county containing in <br />excess of fifty (50) taxing units, ninety-five (95) percent of which <br />are small in comparison to ..taxes levied by a _few large units; and <br /> <br />WHEREAS, the board size and method of selecting said board pro- <br />vides in Sections 6.03(a) and (d) would not provide a fair and <br />equitable board under the particular circumstances in Harris County; <br />and <br />
