<br />e <br /> <br />e <br /> <br />COUNTY Harris <br />CSl 0389-12-064 <br />PROJECT NUMBER NH 96(717) <br /> <br />STATE OF TEXAS. <br /> <br />COUNTY OF TRA VISo <br /> <br />ADVANCED FUNDING AGREEMENT <br />ASSOCIATED WITH THE CONSTRUCTION OF AN 8" PVC WATER MAIN INSIDE <br />A 16" STEEL CASING AT STATION 479+195 AND STATION 507+40 ON SH 146 <br /> <br />THIS AGREEMENT MADE BY AND BETWEEN the State of Texas, acting by and through the Texas <br />Department of Transportation, hereinafter called the State, and the City of La Porte, Texas, acting by and through <br />its authorized officials, hereinafter called the City. <br /> <br />WITNESSETH <br /> <br />WHEREAS, Chapter 201, et.seq. of the Transportation Code and Chapter 221.001 of the Transportation Code <br />authorize the State to layout, construct, maintain, and operate a system of streets, roads, and highways that <br />comprise the State Highway System; and, <br /> <br />WHEREAS, Commission Minute Order Number 85094 authorizes the State to enter into the necessary agreements <br />for highway improvements and/or modifications with appropriate public and/or private entities, to execute necessary <br />advanced funding agreements and to proceed with the development of associated projects; and, <br /> <br />WHEREAS, the City has requested that the State allow the City to participate in said highway improvements <br />generally described as construction of an eight (8) inch diameter PVC water main inside a sixteen (16) inch diameter <br />steel casing at Station 479+95 and Station 507+40 on State Highway 146, by funding that portion of the <br />improvement described above, hereinafter called the "Project" and further described in the sketch attached hereto <br />and labeled Exhibit A; <br /> <br />NOW, THEREFORE, in consideration of the premises and of the mutual covenants and agreements of the parties <br />hereto, to be by them respectively kept and performed as hereinafter set forth. the State and the City do agree as <br />follows: <br /> <br />AGREEMENT <br /> <br />Article 1. Time Period Covered <br /> <br />This agreement becomes effective when signed by the last party whose signing make the agreement fully executed, <br />and the State and the City will consider it to be in full force and effect until the Project described herein has been <br />completed and accepted by all parties or unless terminated as hereinafter provided. <br /> <br />Article 2. Scope of Project <br /> <br />The State and the City agree that the scope of the Project shall be limited to those items necessary to construct an <br />eight (8) inch diameter PVC water main inside a sixteen (16) inch diameter steel casing and wet connections at <br />Station 479+95 and Station 507 +40 on State Highway 146, as depicted in Exhibit A of this agreement. <br />
