<br />e <br /> <br />e <br /> <br />ORDINANCE NO. 2002-2603 <br /> <br />AN ORDINANCE ESTABLISHING A COMMUNITY SERVICE PROGRAM FOR THE CITY <br />OF LA PORTE, FINDING COMPLIANCE WITH THE OPEN MEETINGS LAW, AND <br />PROVIDING AN EFFECTIVE DATE HEREOF. <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LA PORTE: <br /> <br />Section 1. <br /> <br />The city Council hereby adopts Texas Code of <br /> <br />criminal Procedure Article 45.521, whereby authority is given to a <br />justice or judge of a municipal court to require a defendant to <br />discharge previously assessed court fines or costs through <br /> <br />performance of community service work, and Texas Code of Criminal <br /> <br />Procedure Article 45.54, whereby community ,service may be imposed <br />as a condit~on of an order of deferred disposition. Texas Code of <br />criminal Procedure Articles 45.521 and 45.54 are incorporated by <br /> <br />reference in this section, and made a part of this section as fully <br />as if copied at length in this section; a copy is on file in the <br />office of the City Secretary. <br />Section 2. It shall be the official policy of the City of La <br />Porte to establish a community service program as authorized by the <br /> <br />above referenced provisions of the Texas Code of Criminal <br /> <br />Procedure. Pursuant to said code, community service work ordered <br />by the Municipal Court shall be performed only for a governmental <br /> <br />entity or non-profit organization that provides services to the <br />general public that enhance social welfare and the general well- <br /> <br />being of the community. <br /> <br />Section 3. The Judge of the Municipal Court of the City of La <br /> <br />Porte is hereby authorized to administer the community service <br /> <br />program created by this ordinance in any such manner that comports <br />with the conditions and requirements of the Texas Code of Criminal <br /> <br />Procedure. <br />
