ORDINA1~CE NO. 101 THE LAND SUBDIVISION REGULATIONS OF THE CITY OF LOHAX, TEXAS AN ORDINANCE ADOPTING THE PROMULGATING RULES AND REGULATIONS GOVERNING THE PLATTING OF LAND INTO SUBDIVISIONS IN THE CITY OF LOMAX, REQUIRING PLATS TO CO~FORH TO SUCH RULES AND REGULATIONS IN ORDER TO PROCURE THE APPROVAL OF THE COUNCIL OF THE CITY OF LOMAX, DEFINING TE&~S: FORBIDDING TRANSFERS OF LAND WITHOUT COMPLYING WITH THE TERMS OF THIS ORDINANCE: PROVIDING FOR VARIANCES FRO~I THE PROVISIONS OF THIS ORDINANCE: PROVIDING PENALTIES FOR THE VIOLATION OF ANY OF THE PROVISIONS OF THIS ORDINANCE: PROVIDING FOR THE SEPARABILITY OF PROVISIONS OF SAID ORDINANCE AND PROVIDING FOR THE EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF Lm-lAX AS FOLLOH'S: ARTICLE ONE GENERAL PROVISIONS AND REQUIREMENTS S,ECTION 1, TITLE: This ordinance shall be knO'lvtl, cited, and referred to as "The Land Subdivision Regulations of the City of Lomax, Texas." SECTION 2, ADOPTION OF LEGISLATIVE GRANT OF POHER: Article 974a, Vernon's Revised Civil Statutes, and any amendments thereto are hereby adopted, and the provisions of this ordinance are adopted in exercise of power granted to muni- cipalities by such statute as well as all other powers granted to cities through appropriate provisions of the laws and Constitution of the State of Texas. SECTION 3, PURPOSE: This ordinance is to provide for the harmonious develop- ment of the City of Lomax and its environs, for the coordination of streets within the subdivision and other existing or planned streets for access to and extension of public utility facilities, for adequate open spaces for traffic, ~ecreation, light and air, and for the distribution of population and traffic which will tend to create conditions favorable to health, safety, morale, and the general t'l7elfare of the City of Lomax, hereinafter referred to as the City. SECTION 4, SCOPE AND JURISDICTION: Hereafter, before any plan, plat, or replat of a subdivision or addition of land inside the City shall be recorded with the County Clerk, it shall be first approved by the City Council in conformance with the provisions of this ordinance. The filing of any plan, plat, or replat without complying with the requirements of this ordinance, or the transfer of land by filing of any instrument in the nature of a conveyance without having first complied with the requirements of this ordinance, shall be deemed a vio- lation of the provisions of this ordinance. SECTION 5, CITY PARTICIPATION IN COST: A. The subdivider will be required to install at his own expense, all water lines, streets, sewer lines, storm sewer lines, and drainage facilities and structures within the subdivision in accordance with the City's Standards governing the same and as set forth herein, including all engi- neering costs covering design, layout and construction. ~fuen a street pavement of a greater width than twenty-eight (28) feet back of curb to back of curb, is required by the City, the City may pay the cost of paving the additional width. B. There will be no participation by the City in the cost of any' of the under- ground utility lines or drainage facilities within the subdivision except in the event of the requirement for oversize lines to serve land areas and " improvements beyond the subdivision in question, or to serve other subdivi- sions. C.
