<br />" <br />..v,.a. . <br /> <br />. <br /> <br />... ,. <br /> <br />-":. <br /> <br />. <br /> <br />~ <br /> <br />.. .... ..~ <br /> <br />.. .~ <br /> <br />.'-. .." <br /> <br />\, <br /> <br />. <br />. . <br /> <br />The City Council may authorize a variance from these regulations. <br /> <br />ARTICLE EIGHT <br /> <br />BUILDING PERHITS, CITY ACCEPTANCE OF DEDICATION AND UTILITY SERVICE: <br /> <br />SECTION 1, BUILDING PERlUTS: No employee or official of the City shall issue <br />building or repair permits for any structure located on a lot in any subdivision, <br />the plat of which has been prepared after the date of teh adoption of this ordi- <br />nance, unless such plat has been approved and recorded in accordance with the <br />provisions contained herein. <br /> <br />SECTION 2, ACCEPTANCE: The approval of any plat or replat shall not be deemed <br />an acceptance of the proposed dedications and shall not impose any duty upon <br />the City concerning the maintenance or improvement of any such proposed dedica- <br />tions until the proper authorities of the City shall have made actual appropria- <br />tion of the same by entry, use, or improvement. <br /> <br />~ECTION 3, SERVICE: Unless and until any such plans, plats, or replats and <br />specifications shall have been first approved in the manner and by the authori- <br />ties provided for herein, it shall be unlawful within the area covered by said <br />plans, plats, or replats for any City official or employee thereof to serve or <br />connect said land or any part thereof with any public utility, such as water, <br />sewer, lights, gas, etc., which may be owned, controlled, regulated, or distri- <br />buted by the City. <br /> <br />ARTICLE NINE: <br /> <br />PENALTIES FOR VIOLATION <br /> <br />SECTION 1: Violations of any provision or prov1s10ns of this ordinance by any <br />person shall constitute a misdemeanor and upon conviction of such violation a <br />fine of not less than one dollar ($1.00) nor more than two hundred dollars ($200) <br />shall be imposed, and each day that such violation continues shall be a separate <br />offense. <br /> <br />,\ " <br /> <br />SECTION 2: No conviction or convictions under the penal provisions of this <br />ordinance shall ever be considered as any bar to any injunction or other legal <br />remedy, relief, right, or power existing in the City to enforce the application <br />and provisions of this ordinance by virtue of the constitution and laws of the <br />State of Texas and Charter of the City. The City Council may refuse to approve <br />any future plats of any developer or subdivider or any corporation whether a <br />subdivider or parent wherein the developer or subdivider owns more than a fifty <br />percent interest until any previous delinquencies in specifications for former <br />plats have been corrected. <br /> <br />ARTICLE TEN: <br /> <br />SEPARABILITY OF PROVISIONS AND PUBLICATION OF TIlE ORDINANCE: <br /> <br />SECTION 1, SEPARABILITY: It is hereby declared to be the intention of the <br />City Council that the several provisions of this ordinance are separable, in <br />accordance with the following: <br /> <br />" <br />. <br /> <br />A. If any court or competent jurisdiction shall judge any provision of this <br />ordinance to be invalid, such judgment shall not affect any other pro- <br />vision of this ordinance not specifically included in said judgment. <br /> <br />B. If any court of competent jurisdiction shall judge invalid the application <br />of any provision of.this ordinance to a particular property, such judgment <br />shall not affect the application of said provision to any other property <br />not specifically included in said judgment. <br /> <br />-19- <br />
