ARTICLE EIGHT BUILDING PERHITS, CITY ACCEPTANCE OF DEDICATION AND UTILITY SERVICE: SECTION 1, BUILDING PERlUTS: No employee or official of the City shall issue building or repair permits for any structure located on a lot in any subdivision, the plat of which has been prepared after the date of teh adoption of this ordi- nance, unless such plat has been approved and recorded in accordance with the provisions contained herein. SECTION 2, ACCEPTANCE: The approval of any plat or replat shall not be deemed an acceptance of the proposed dedications and shall not impose any duty upon the City concerning the maintenance or improvement of any such proposed dedica- tions until the proper authorities of the City shall have made actual appropria- tion of the same by entry, use, or improvement. ~ECTION 3, SERVICE: Unless and until any such plans, plats, or replats and specifications shall have been first approved in the manner and by the authori- ties provided for herein, it shall be unlawful within the area covered by said plans, plats, or replats for any City official or employee thereof to serve or connect said land or any part thereof with any public utility, such as water, sewer, lights, gas, etc., which may be owned, controlled, regulated, or distri- buted by the City. ARTICLE NINE: PENALTIES FOR VIOLATION SECTION 1: Violations of any provision or prov1s10ns of this ordinance by any person shall constitute a misdemeanor and upon conviction of such violation a fine of not less than one dollar ($1.00) nor more than two hundred dollars ($200) shall be imposed, and each day that such violation continues shall be a separate offense. ,\ " SECTION 2: No conviction or convictions under the penal provisions of this ordinance shall ever be considered as any bar to any injunction or other legal remedy, relief, right, or power existing in the City to enforce the application and provisions of this ordinance by virtue of the constitution and laws of the State of Texas and Charter of the City. The City Council may refuse to approve any future plats of any developer or subdivider or any corporation whether a subdivider or parent wherein the developer or subdivider owns more than a fifty percent interest until any previous delinquencies in specifications for former plats have been corrected. ARTICLE TEN: SEPARABILITY OF PROVISIONS AND PUBLICATION OF TIlE ORDINANCE: SECTION 1, SEPARABILITY: It is hereby declared to be the intention of the City Council that the several provisions of this ordinance are separable, in accordance with the following: " . A. If any court or competent jurisdiction shall judge any provision of this ordinance to be invalid, such judgment shall not affect any other pro- vision of this ordinance not specifically included in said judgment. B. If any court of competent jurisdiction shall judge invalid the application of any provision of.this ordinance to a particular property, such judgment shall not affect the application of said provision to any other property not specifically included in said judgment. -19-
