0 • <br />AGREEMENT BETWEEN HARRIS COUNTY <br />AND <br />THE CITY OF LA PORTE <br />FOR <br />DO«`NPAYMENT AND CLOSING COST ASSISTANCE PROGRAM <br />THIS Agreement is made and entered into by and between Harris County, a body, politic and <br />corporate under the laws of the State of Texas, herein called the "Grantee" and the City of La <br />Porte. a Texas body politic and corporate under the laws of the State of Texas, herein called the <br />"Subrecipient." <br />WHEREAS, the Grantee has applied for and received funds from the United States Government <br />under the Home Investment Partnerships (HOME) Program, application number M -02 -UC -48- <br />0215; 2002-047; <br />WHEREAS, the primary purpose of the HOME program pursuant to the National Affordable <br />Housing Act of 1990 (NAHA) and 24 C.F.R. Part 92, is to benefit low and very -low income <br />citizens by providing them with affordable housing; <br />WHEREAS, the Grantee and the Subrecipient desire to enter into an agreement whereby the <br />Grantee will grant funds to Subrecipient for the purpose of a Homebuyers Assistance Program <br />for the benefit of low income residents to purchase homes, which is an eligible activity under the <br />rules and regulations regarding HOME Program grant funds, in accordance with the terms and <br />conditions described herein; and <br />WHEREAS, the Subrecipient shall insure recognition of the role of the Grantee Department in <br />providing services through this contract. All activities, facilities, and items utilized pursuant to <br />this contract shall be prominently labeled as to funding source. In addition, the Subrecipient will <br />include reference to the Office of Housing and Economic Development "OHED" for the support <br />provided herein in all publications made possible with funds made available under this <br />agreement. <br />NO%V. THEREFORE, in consideration of the mutual covenants and agreements herein <br />contained. it is agreed between the parties hereto that: <br />SCOPE OF ACTIVITIES <br />Subrecipient agrees to provide the activities described in Exhibit A, attached hereto and <br />incorporated herein for all purposes, in accordance with the provisions of this Agreement <br />and in compliance with the requirements of Title 1 of the Housing and Community <br />Development Act of 1974 and all regulations issued thereunder. <br />-k. Eheible Activity <br />The Subrecipient agrees to maintain documentation that demonstrates that the activities <br />carried out with funds provided under this Agreement meet the following eligible activity <br />relating to the HOME Program at 24 C.F.R. § 92.205(a)(1) which states that funds may <br />be used by a participating jurisdiction to provide for downpayment and closing costs <br />
