The contracting entity awarding any contract for non-federally funded, public works constnJctIon projects <br />(regardless of size or dollar value) shall include in bid specification documents and contract documents a <br />prevailing wage rate determination of per diem wages for the locality in which the work is to be performed, <br />. for each craft or type of workman or mechanic needed to execute the contract. The Prevailing Wage Rate <br />Determination is defined as (1) the Prevailing Wage Rate Detennlnatlon Information sheet (documenl <br />.' nUmbi!r WR1001), (2) the Prevailing Wage Rate Determination for Building Construction Trades, and (3) <br />the Department of Labor (DOL) Heavy Highway Determination. The DOL Heavy Highway rates are to be <br />p~d to workers engaged In sile work detennlned to be fIVe (5) feet beyond the building, extending to the <br />property boundary. ' <br /> <br />2. It shall be the responsibility of the contracting entity to ensure that the General Contractor posts the <br />applicnble Prevailing Wage Rate Detennlnation in a prominent. ~ accessible place al the work site. <br /> <br />3. It shall be the responsibility of the contracting entity to ensure that nolless than the posted, sp~cjfied ratos <br />are paid to all classifications of workmen, mechanics and laborers employed by the General Contractor <br />and/or Subcontractors, In the execution of their contract with the contracting entlly, and to ensure that all <br />workers fit Into one of the listed worker classifications for work of a similar character. For example, <br />welders are to be paid the rate of pay for the trade they are working for. <br /> <br />4. It shall be the responsibility of the contracting entity to take cognlnnce of wage rate disputes andlor <br />compluints of all violations of the provisions of Chapter 2258 Texas Government Code Tille 10. <br /> <br />5. It shall be the responsibility of the contracting entity to address the issue of fringe benefits in the bid <br />specification documents and contract documents. The Prevailing Wage Rate Deteonlnatfons produced by <br />the General Services Commission include fringe benefits in the total Wages. The bid specfflcation <br />documents and cxmtract documents need to specify whether the contracting entity Is requiring that fringe <br />benefi!s be paid. <br /> <br />6. It shall be the responsIbility of the contracting entity to address the Issue of the use of apprentices and <br />their payment rate In the bid specification documents and contract documents. The rales specified in the <br />Prevailing Wage Rate Detennlnatlon produced by the General Services CommIssion are Journeyman <br />rates. Historically, the apprentice rate Is commensurate with the experience and skill of the workor. For <br />example, on GSe projects, apprentices are paid at a rate of not more than 60% of the journeyman's wage. <br />Also on GSC projects, at no time shall a journeyman supervise more than one (1) apprentice. <br /> <br />Note: The terms joumoyman and apprentice apply to both union and Independent workers, and are not <br />Intended to imply that these positions are union workers only. <br /> <br />1. Some Prevailing Wage Rate Detannlnatlons for Building Cons(ruction Trades may Indicate $0.00 in the <br />-Total Wage- column, rather than a dollar amount. In such cases, The General Services CommIssion did <br />not reCc~ive sufficient survey data to tabulate a prevailing wage for this worker classification, In the <br />specified area, and can not provide a prevailing wage rate for this classification.
