<br />COUNTY OF HARRIS
<br />
<br />KNOW ALL MEN BY THESE PRESENTS, That
<br />(hereinafter called "Principal"), as Principal, and , a corporation
<br />organized and existing under the laws of the State of Texas and authorized to act as surety
<br />on bonds for principals (hereinafter called "Surety"), as Surety, are held and firmly bound
<br />unto the City of La Porte, County of Harris, State of Texas (hereinafter called the "City"), as
<br />City, in the penal sum of Dollars ($ .00) for the
<br />payment whereof, the said Principal and Surety bind themselves, and their heirs,
<br />administrators, executors, successors and assigns jointly and severally, firmly by these
<br />presents:

<br />WHEREAS, the Principal has entered into a certain written contract with the City,
<br />dated the _ day of _,200_, for Commercial and Industrial Solid Waste Collection and
<br />Disposal, which Contract is hereby referred to and made a part thereof as if fully and to the
<br />same extent copied at length herein, consisting of the Request for Proposal, Instructions to
<br />Proposers, Proposal, Affidavit, Proposal Bond, Contract, General Specifications including
<br />Exhibits A, B, C and D, and any changes to the foregoing documents agreed to by the City
<br />and the Principal.

<br />NOW THEREFORE, THE CONDITION OF THIS OBLIGATION IS SUCH, that if the
<br />said Principal shall faithfully perform the conditions of the Contract, free and clear of all
<br />liens arising out of claims for labor, materials and other services necessary for the
<br />performance of the Contract, and indemnify and save harmless the City from all losses,
<br />cost or damage that the City may suffer by reason of the failure of the Principal's failure to
<br />do so, then this obligation shall be void; otherwise this obligation shall remain in full force
<br />and effect.
<br />
<br />Surety, for value received from the Principal, stipulates and agrees that no change,
<br />extension of contract term, alteration or addition to the terms of the Contract, or other work
<br />performed thereunder shall in anywise affect its obligation on this bond, and it does hereby
<br />waive notice of any such change, extension of term, alteration or addition to the terms of
<br />the Contract, or the work to be performed thereunder.
