<br />e <br /> <br />e <br /> <br />(d) This section does not prohibit the construction of homes <br />or buildings, otherwise authorized by applicable codes and <br />ordinances of the City of La Porte, upon the property of <br />adjoining and abutting landowners, provided that said <br />construction and occupancy of said homes and buildings does <br />not violate the terms of this section. <br /> <br />(e) This section does not prohibit normal farming and ranching <br />operations, which are othe~lise not prohibited by the terms <br />and provisions of any City of La Porte code or ordinance, <br />except that livestock shall not be allowed within a 50 foot <br />radius of the property line of the lot, tract, or parcel of <br />land, upon which each City of La Porte water well listed on <br />Exhibit nAil attached hereto, is described and located. (Said <br />Exhibit is attached to Ordinance No. 2001-a~~ copy of which <br />may be obtained from the office of the City-Secretary of the <br />City of La Porte.) <br /> <br />(f) Penalty for Violation of Section. Any person, as defined <br />in V.T.C.A., Penal Code S1.07(27), who shall violate any <br />provision of this section shall be deemed guilty of a <br />misdemeanor, and, upon conviction, shall be punished as <br />provided in section 1-14. Each day any violation of this <br />section shall continue shall constitute a separate violation. II <br /> <br />Section 2. <br /> <br />If <br /> <br />any provision, <br /> <br />section, <br /> <br />subsection, <br /> <br />sentence, clause, or phrase of this ordinance, or the application <br /> <br />of same to any person or set of circumstances is for any reason <br /> <br />held to be unconstitutional, void or invalid, the validity of the <br />remaining portions of this ordinance or their application to other <br /> <br />persons or sets of circumstances shall not be affected thereby, it <br />being the intent of the City Council in adopting this ordinance <br />that no portion hereof or provision or regulation contained herein <br />shall become inoperative or fail by reason of any unconstitution- <br />ality, voidness or invalidity of any other portion hereof, and all <br /> <br />provisions of this ordinance are declared to be severable for that <br /> <br />purpose. <br /> <br />Section 3. <br /> <br />Any person who violates a provision of this <br /> <br />ordinance, upon conviction in the municipal court of the City of La <br /> <br />Porte, shall be subject to a fine not to exceed two thousand <br /> <br />2 <br />
