<br />e <br /> <br />. <br /> <br />ORDINANCE NO. 2001-2474-A <br /> <br />AN ORDINANCE AMENDING CHAPTER 74, "UTILITIES", ARTICLE II, <br />"INDUSTRIAL WASTE", OF THE CODE OF ORDINANCES OF THE CITY OF LA <br />PORTE, SAID ARTICLE BEING THE INDUSTRIAL WASTE ORDINANCE OF THE <br />CITY OF LA PORTE, REGULATING THE DISCHARGE OF INDUSTRIAL WASTE INTO <br />PUBLIC SEWERS OF THE CITY OF LA PORTE, TEXAS, PROMULGATING <br />REGULATIONS AND ESTABLISHING CHARGES FOR SERVICES RENDERED; <br />PROVIDING THAT ANY PERSON VIOLATING THE TERMS OF THIS ORDINANCE <br />SHALL BE DEEMED GUILTY OF A MISDEMEANOR AND SHALL UPON CONVICTION <br />BE FINED NOT TO EXCEED TWO THOUSAND DOLLARS ($2, 000.00), AS <br />PROVIDED IN APPENDIX B OF THE CODE OR ORDINANCES OF THE CITY OF LA <br />PORTE; EACH DAY OF VIOLATION SHALL BE DEEMED A SEPARATE OFFENSE; <br />CONTAINING SEVERABILITY AND REPEALING CLAUSES; FINDING COMPLIANCE <br />WITH THE OPEN MEETINGS LAW; AND PROVIDING AN EFFECTIVE DATE HEREOF. <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LA PORTE: <br /> <br />Section 1. Chapter 74, "utilities", Article II, "Industrial <br /> <br />Waste", Section 11, "Judicial Enforcement Remedies", Paragraph <br /> <br />11.1, "Injunctive Relief", is hereby amended, and shall hereafter <br /> <br />read as follows, to-wit: <br /> <br />"11.1 <br /> <br />Injunctive Relief <br /> <br />Whenever the user has violated a pretreatment <br />standard or requirement or continues to violate the <br />provisions of this ordinance, wastewater discharge <br />permi t or orders issued hereunder, or any other <br />pretreatment requirement, the Director may petition <br />any court of competent jurisdiction through the <br />City Attorney for the issuance of a temporary or <br />permanent injunction, as appropriate, which <br />restrains or compels the specific performance of <br />the wastewater discharge permit, order, or other <br />requirement imposed by this ordinance on activities <br />of the industrial user. Such other action as <br />appropriate for legal and/or equitable relief may <br />also be sought by the Ci ty . A petition for <br />injunctive relief need be filed as a prerequisite <br />to taking any other action against a user." <br /> <br />Section 2. The City Council Officially finds, determines, <br /> <br />recites, and declares that a sufficient written notice of the date, <br /> <br />hour, place and subject of this meeting of the City Council was <br />posted at a place convenient to the public at the City Hall of the <br />
