U. Stabler, his heirs, <br />successors and assigns, to construct, build, extend, maintain and <br />operate, an electric light, electric poles, stringing wires in and <br />upon all of the public thoroughfares, streets, alleys, roads and <br />highways, within the corporate limits of the City of La Porte, <br />Harris County Texas; and the building of a power plant to generate <br />the electric cur~ent for heating,lighting, and power purposes and <br />defining the rights, priveleges and powers hereto, including the <br />fixing of a tariff to be charged for the electric current. <br /> <br />BE IT ORDAINED:-by the Board of Aldermen of the City of La Porte, <br />Harris Coupty Texas. <br /> <br />~ection One: J. U. ~tabler, his heirs, succes- <br />sors and assigns, be and are hereby granted the right, privelege <br />and franchise, to enter upon any and all streets, squares, parks, <br />alleys or other public thoroughfares and highways in the City of <br />La Porte, Harris County, Texas, to erect poles of a substantial <br />size and material, string wires thereon for the conveying of elec- <br />tric current for heating, lighting and power purposes, in, upon, <br />over and acrosS any stream or streams, bridge or bridges, o\Jned or <br />controlled by the City of La Porte, and to maintain and operate his <br />or their electric poles, wires and power plants, and all other n9ces <br />sary apparatus, used in connection with and incident to the build- <br />ing, establishment and operation of an electric power plant for the <br />manufacture and distribution of electric current for heating, light- <br />,,' ing and power purpos es. <br />,;/ <br /> <br />j <br />,I" <br />" <br /> <br />Section Two: That all poles and wires placed, erected, or con- <br />structed for the distribution of electric current for heating, <br />lighting and power purposes, shqll be so placed as not to impede or <br />interfere in any manner with the usei of the streets or sidewalks' <br />by the travelling public; shall be of standard eqipment and construe <br />tion, and so constructed as to minimize the risk of life end pro- <br />perty, and shall be placed, erected, built and constructed at such <br />places, and in such manner as may be designated and specified by the <br />board of Aldermen of the City of La Porte, or such persons as they <br />may authorize to act for them; and the surface of said streets, <br />alleys, parks or other public thoroughfareS and highways, when ex- <br />cavated or used in any manner by the said J. U. Stqbler, his heirs, <br />successors and assigns shall be restored and placed in good condi- <br />tion as they were before said excavation was made; and all poles, <br />arms, "Tires and other materia.l and apparatus, including implements <br />and tools used in erection, construction or repair of said electric <br />light plant, shall at all times be kept off the streets and side- <br />walks so as not obstruct the reasonable usa thereof by the publio. <br />In casa the City Council of the City of La Porte shall grant <br />the use of the streets or alleys for the purpose of moving build- <br />ings, th~ wires shall be raised or lowered at the cost of ~aid J.U. <br />Stabler, his heirs successors or assigns, for that purpose. <br /> <br />Section Three: That J. U. Stabler, his heirs, succes~ors and <br />assigns shall furnish a good first-class, high gr~.d,e, electric <br />power plant and provide electric current for heat.ingt lighting and <br />power purpo;es to the r.esidents of the City of La Porte at a rate <br />of one Dollar E month as a minimum charge, and regular rates to be <br />25 per cent aboye those charged the ci t1zens of Houston Te::tas, by <br />the Houstdln lighting and po\ver 6ompany, s'aid power to bo oporated, <br />and said, electric current furnished and supplied between the hours <br />of 5 P.M. and 7 A.M. from the first day of March until the first <br />day of October of each year; and from the hours of 4 P.~. to 7 A.M. <br />from the first (l8.Y of Novembor until the first day of narch during <br /> <br />each year. <br /> <br />. <br />
