<br />AN ORDDfANCE PROVIDING FOR THE COMPELLING OF PROPERTY

<br />CONSTRUCT,OR REPAIR SIDE WALKS, DRIVE WAYS, CURBS AND/OR GUTTERS

<br />OR EITHER OF, THEM, Al'.jD; PROVIDING FOR P:b"'1~ALTIES FOR FAILURE TO SO

<br />CONSTRUCT' OR. REPAI~ WHE.~ P~pPERLY HOTIFIED TO SO DO, and CREATING
<br />
<br />A LIEN ON ABUTTING PROPERTY WHERE CONSTRUCTION OR REPAIRS HAVE
<br />
<br />BEEN MADE.
<br />
<br />BE IT ORDAINED by the City Council of the City of La
<br />
<br />Porte, Texas:
<br />
<br />That every owner of real estate situated in the City
<br />of LaPorte, Texas, when such real estate abuts on any public
<br />street within the city limits shall when ordered by the City
<br />Council to do so, construct, re-construct, repair or bring to
<br />grade side walks, drive ways, curbs or gutters or either of them,
<br />as the case may be, in accordance with the terms of said ~der
<br />and the specifications hereinafter set out and adopted and on
<br />the line and grade as established by the engineer for the City
<br />of LaPorte.

<br />The said property owners shall construct said side
<br />walks, drl. ver-'wa:-ys-;--cu-rb-s-o-r-:-gu-t-t'e-rs--oT-e-i-t-lie-r-, G-f"--the.m- a.nd/or -- --.
<br />repair the same when so ordered within sixty (60) days after
<br />notice has been given by the City Council to do such construc-
<br />tion or make such repairs. The. mailing under the direction of
<br />the City Council of an order to the property owners to make
<br />such repairs shall constitute notice to such property owners.
<br />Said property owners shall constru'ct said side walks, drive
<br />ways, curbs or gutters or either of them or make such repairs
<br />to the seme in a uniform manner; the cement, sand and gravel or
<br />other material to be of such quality as specified in said notice.
<br />
<br />Said property owners shall pay two-thirds (2/3) of
<br />the costs of construction or repair of said side walks, drive
<br />ways, curbs or gutters or either of them and the City of LaPorte
<br />shall pay one-third (1/3) of the cost of such constr-uction or
<br />repairs. Wh&.e said property owner ~~al1 fail or refuse to con-
<br />struct or repair said side walks,' d~ive ways, curbs or gutters
<br />or either of them within the time specified in 'this ordinance,
<br />then the City of LaPorte ,through its City Counc il when the City
<br />Council shall deem such const~ction or repairs necessary, shall

<br />the property owner. The City Council may adver~1se-for bids' for
<br />said construction or repairs or may itself construct or repair
<br />said side walks,. drive ways,' curbs or gutters or' either of thetP,
<br />the expense of said construction or repairs to be pro-rated as
<br />above mentioned and' in the event the property owner where such con-
<br />struction or repairs have been made by the City faiis or refuses
<br />to pay for ,the same" said amount shall bear interest at the rate
<br />of six (6%)' peI'cent per annum from the date such cons truction or
<br />repairs have 'been comp1et~d and ten (10%) percent shall be added
<br />to the principal and interest as attorney's fees, said amount
<br />owing by slich property owner shall be dy.e and payable to the
<br />City of LaPorte when such construction or repairs have been com-
<br />pleted, the amount 'owing by the propertyONner either principal~
<br />interest or.attorneyls fees to the City of LaPorte where the Cl.ty
<br />has done such construction or made such repairs shall constitute
<br />a lien in' favor of the City of LaPorteJ against the property along
<br />which such, constru'ction. 9r repairs have ,been made.
