(2) The Commission is the Approving Authority for all Major Development Plans. Following <br />review of the Major Development Site Plan, the Commission shall take one of the following <br />actions: <br />a. Approve the Major Development Site Plan as filed. Approval of a Major Development Site <br />Plan and all accompanying documentation by the Commission, together with approval of <br />construction documents for any proposed public improvements by the Director results in <br />issuance of a Development Authorization by the Department. <br />b. Conditionally approve the Major Development Site Plan as filed, provided, the reasons for <br />such conditional approval are stated in writing and a copy of the statement is signed by the <br />Chairman of the Commission. Conditional approval of a Major Development Site Plan requires <br />that the Developer satisfy the conditions established by the Commission. Once the stated <br />conditions have been satisfied, the Major Development Site Plan and accompanying <br />documentation may be refiled for Commission approval. <br />c. Disapprove the Major Development Site Plan as filed, provided, the reasons for such <br />disapproval are stated in writing and a copy of the statement is signed by the Chairman of the <br />Commission. Disapproval of a Major Development Site Plan requires filing of a new Major <br />Development Site Plan. <br />(3) Commission action shall be noted on four (4) copies of the Major Development Site Plan, which <br />shall be distributed to the developer, Department, City Code Enforcement Division, and official <br />Commission files. <br />(4) Unless stipulation for additional time is agreed to by the developer, the failure of the <br />Commission to act within thirty (30) days from the date of submittal of the Major Development <br />Site Plan the Developer may submit a written request to the City Manager for an investigation into <br />the Director's failure to act, in answer to which the City Manager shall issue a report within (2) <br />weeks, unless the Director has sooner acted on the submitted Plan. <br />(5) Prior to issuance of a Certificate of Occupancy or final inspection of any improvements included <br />in an approved Major Development Site Plan, a letter signed and stamped by a licensed engineer <br />must be submitted to the Planning and Development Department certifying that all improvements <br />have been installed in accordance with the approved Major Development Site Plan. <br />(d) Amendments to Minor and Major Development Site Plans <br />(1) Amendments to minor and major development site plans are those that provide for <br />rearrangement or reconfiguration of floor plans or building elevations, modifications to parking <br />areas, landscape areas, drainage facilities, utilities or other site improvements. An amendment may <br />only occur to a site plan that has an active building permit on file. <br />(2) Said modifications shall: <br />a. Comply with all requirements of Chapter 106 of the City's Code of Ordinances and other <br />applicable city regulations. <br />15 <br />Thursday, June 09, 2016 <br />
