AGRICULTURAL USE: Any activity related to the cultivation of the soil, the producing of crops to human <br />food, animal feed or planting seed or for the production of fibers; floriculture, viticulture or horticulture <br />raising or keeping of livestock; and planting cover crops or leaving land idle for the purpose of participating <br />in any governmental program or recognized, normal crop or livestock rotation procedure. A residential unit <br />and related accessory buildings located solely for one or more of the purposes described in the preceding <br />sentence shall be deemed an agricultural use. <br />ALLEY: A public right-of-way that is used for utility installation or for secondary access to individual <br />properties that have their primary access from an adjacent public street or an approved common or <br />compensating open space or court yard that has direct access to a public street. <br />APPROVING AUTHORITY: The Planning and Zoning Commission or the City official having authority <br />to sign plats or plans signifying City approval of said plats or plans. For Minor Developments and <br />Administrative Plats, the Approving Authority is the Director of Planning and Development. For all other <br />developments or subdivisions, the Approving Authority is the Planning and Zoning Commission. <br />BUILDING SETBACK LINE: A line that is the required minimum distance from the street right-of-way <br />line or easement line or any other lot line that establishes the area where any structure must be erected or <br />placed. <br />BLOCK: An identified tract or parcel of land established within a subdivision surrounded by a street or a <br />combination of streets and other physical features that may be further subdivided into individual lots or <br />reserves. <br />BUILDING PERMIT: A permit for improvements granted by the Chief Building Official under the <br />provisions of the City Building Regulations currently in force and effect. As used herein, the term <br />"improvement" shall include the construction, enlargement, alteration, repair, removal, or conversion of a <br />building or structure. <br />CHIEF BUILDING OFFICIAL: The City officer or other designated authority charged with the <br />administration and enforcement of the City Building Regulations, or his/her authorized representative. <br />CITY: The City of LaPorte, Texas. <br />CITY BUILDNG REGULATIONS: All building regulations referred to in and incorporated by Chapter <br />82 of the City's Code of Ordinances. <br />CITY COUNCIL: The City Council of the City of LaPorte, Texas. <br />CITY SECRETARY: The person holding the office of City Secretary under the terms of the La Porte <br />Charter, or her/his designated representative. <br />COMMISSION: The Planning and Zoning Commission of the City. <br />COMPENSATION OPEN SPACE: Those areas designated on a plat or plan that are restricted from <br />development, except for landscaping and recreational uses and which all owners of residential properties <br />within the plat have a common legal interest or which are retained in private ownership and restricted from <br />development, except for landscaping and recreational uses, for the exclusive use of all owners of residential <br />3 <br />Thursday, June 09, 2016 <br />
