i. • <br />IV <br />That it is not practicable or feasible, or within <br />the contemplation of those acting for the City of La <br />Porte to provide the properties owned, operated and managed <br />by petitioner and included within the territory proposed to <br />be annexed, all or any of the entitlements, rights and <br />privileges of property of other citizens of the City <br />of La Porte as Article 1, Section 10 of the Home Rule <br />Charter of the City of La Porte and said Ordinance No. 534 <br />provides shall be furnished. <br />V <br />That should the City of La Porte attempt to extend <br />municipal rights, privileges and services to the property <br />owned by the petitioner as required by Ordinance No. 534, <br />the cost of extending such rights, privileges and <br />services would be prohibitive of any such attempt. <br />VI <br />That the purpose of the proposed annexation is to <br />establish a protective strip of territory surrounding <br />an area which the City of La Porte may desire to annex <br />at some indeterminate future date. That this purpose <br />can be accomplished without including the partitioner's <br />property within the territory proposed to be annexed. <br />VII <br />That if the purpose of the proposed annexation <br />is not to establish a protective strip as alleged in <br />Article VI above, then the purpose and effect of including <br />the petitioner's property within the territory proposed to <br />be annexed is control and subjection to taxation of said <br />property by the City of La Porte without corresponding <br />benefits to said property or the petitioner and is not in <br />the interest of public safety, health or welfare, and is <br />an arbitrary acid unreasonable exercise of the legislative <br />powers vested in the governing officials of the City of <br />-2- <br />
