<br />III <br /> <br />That said Ordinance No. 545 does not give a descrip- <br />tion of the territory proposed to be annexed sufficient to <br />support further action thereon by the City of La Porte. <br />IV. <br />That the real property and chemical plant facilities <br />owned by Celanese and located within the territory proposed <br />to be annexed is not adaptable to or necessary for the munici- <br />pal needs and growth of the City of La .Porte. <br />V <br />That it is not practicable, feasible or within the <br />contemplation of the City of La Porte to make, and said city <br />will not make, available to Celanese or to the property owned <br />by Celanese all or any of the municipal entitlements, rights, <br />privileges and services available to and provided for citizens <br />of the City of La Porte and their property. <br />VI <br />That the purpose of the proposed annexation and the <br />inclusion of the property owned by Celanese within the terri- <br />tort' proposed to be annexed is to control said property and <br />subject same to taxation by the City of La Porte without cor- <br />responding benefits to said property or to Celanese and such <br />purpose is not in the interest of public safety, health or <br />welfare and such proposed annexation is an arbitrary and un- <br />reasonable exercise of the legislative powers vested in the <br />governing officials of the City of La Porte and will result <br />in great damage to the property of Celanese and in the taking <br />thereof without due process of law. <br />WHEREFORE, premises considered, Celanese prays that <br />the Honorable City Commission of the City of La Porte take <br />no action to finally pass said Ordinance No. 545; and in the <br />alternative, that said ordinance be so amended as to exclude <br />- 2_ <br />
