• <br />I~ <br /> <br />ORDINANCE N0. ~ C~ ~ <br />AN ORDINANCE ALTERING THE PRIMA FACIE SPEED LIMITS ESTABLISHED FOR VEHICLES UP- <br />~~ ON STATE HIGHWAY N0. 146 (ALSO KNOWN AS SOUTH BROADWAY), ALONG THE SECTION FROM <br />K STREET TO THE SOUTH CITY LIMITS OF THE CITY OF LA FORTE AT THE BRIDGE OVER <br />LITTLE CEDAR BAYOU, WHILE THE CONSTRUCTION OPERATIONS OF THE STATE HIGHWAY DE- <br />PARTMENT ARE IN PROGRESS; PROVIDING THAT THE ORDINANCE SHALL BECOME INEFFECTIVE' <br />UPON COMPLETION OF THE ROADWAY CONSTRUCTION; AND PROVIDING THAT ANY PERSON VIO- <br />EATING ANY OF THE PROVISIONS OF THIS ORDINANCE SHALL BE DEEMED GUILTY OF A MIS- <br />; DEMEANOR AND UPON CONVICTION THEREOF SHALL BE FINED IN ANY SUM NOT MORE THAN <br />TWO HUNDRED DOLLARS ($200.00), <br />WHEREAS, the Texas Highway Department will begin construction opera- <br /> <br />tions in the near future for the placement of hot-mix asphaltic concrete on <br />State Highway 146 (:also known as South Broadway Street) along the section of <br />roadway from G Street, in the City of La Porte, to the City Limits at the bridge <br />over Little Cedar Bayou; and <br />WHEREAS, in the interest of safety it is desirable to establish a <br />construction speed zone not to exceed forty (40) miles per hour along the high- <br />way construction project, <br />NOW, THEREFORE, BE IT ORDAINED BY THE CITY CO MMISSION OF THE CITY OF <br />1 <br /> <br />LA FORTE, TEXAS, THAT: <br />Section 1. On the basis of an engineering and traffic investigation <br />heretofore made as authorized by the provisions of Section 8 of Article 827a, <br />Vernon's Texas Penal Code, it is hereby determined and declared that forty (4G) <br />miles per hour is the reasonable and safe rate of speed while the construction <br />operations of the State Highway Department, for the placement of hot-mix as- <br />phaltic concrete, is in progress on State Highway 146 (also known as South Broad- <br />way) along the section of road from K Street to the South City Limits of the <br />City of La Porte at the bridge over Little Cedar Bayou, and such speed limit is' <br />hereby fixed at the rate of forty (40) miles per hour for vehicles travelling <br />upan said highway, or parts thereof, along the section from K Street to the said <br />South City Limits, <br />Section 2. Any person violating any of the provisions of this ordi- <br />nance shall be deemed guilty of a misdemeanor, and upon conviction thereof shall; <br />be fined in a sum not more than Two Hundred Dollars ($2f~0.0O). <br />Section 3.
