ORDINANCE NO. 66/ e AN ORDINANCE PROHIBITING SELLING OR DISPENSING OR OFFERING FOR SALE AND DISPENSE AT A SERVICE STATION OF GASOLINE OR OTHER FLAMMABLE LI- QUIDS HA VING A FLASH POINT BELOW 2000 F AHREN- HEIT IN ANY CONTAINER OTHER THAN A METAL CON- TAINER EQUIPPED WITH A CAP OR OTHER SIMILAR DEVICE SUFFICIENT TO PREVENT ESCAPING VAPORS; AND PROHIBITING THE STORING OF GASOLINE AND OTHER FLAMMABLE LIQUIDS HAVING A FLASH POINT BELOW 2000 FAHRENHEIT IN ANY CONTAINER OTHER THAN A METAL CONTAINER EQUIPPED WITH A CAP OR OTHER SIMILAR DEVICE, SUFFICIENT TO PREVENT ESCAPING VAPORS; MAKING A VIOLATION A MISDE- MEANOR AND PROVIDING A PENALTY OF NOT LESS THAN $10. NOR MORE THAN $200. - BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF LA PORTE, TEXAS: Section One: It shall be unlawful for the owner or manager of any service station, filling sta- tion, or dispensing station, or its agents, employees or servants of such owner or manager to sell, dispense, or offer to sell and dispense gasoline or any other flammable liquids having a flash point below 2000 fah- renheit in any type of container other than a metal container equipped with a cap or other similar device sufficient to prevent the escape of vapors. - Section Two: It shall be unlawful for any per- son, firm, corporation, or association to transport, keep, store, or stock gasoline or any other flammable liquid having a flash point below 2000, fahrenheit in any type of container other than a metal container equipped with a cap or other similar device sufficient to prevent the escape of vapors. Section Three: Any person, firm, corpora- tion or association who shall violate the provision of this Ordinance shall be deemed guilty of a misdemeanor and upon conviction thereof, shall be fined not less than $10. nor more than $200. for such offense.
