<br />.' <br /> <br />" <br /> <br />- <br /> <br />~, <br />'.' <br />,~ <br /> <br />... <br /> <br />e <br /> <br />e <br /> <br />." - <br /> <br />; <br /> <br />. <br /> <br />. <br /> <br />--, <br /> <br />" . .::- <br /> <br />"'- <br /> <br />ORDINANCE NO. <br /> <br />676 <br /> <br />AN ORDINANCE ALTERING THE PRIMA FACIE SPEED LIMITS ESTABLISHED <br />FOR VEHICLES UNDER THE PROVlSIONS OF SECTION 8 OF ARTICLE 827s, <br />VERNON'S TEXA,S PENAL CODE, UPON TH;E "BASIS OF AN ENGINEERING AND <br />TRAFFIC INVESTIGATION, UPON CERTAIN STREETS ANDmGHWA YS, OR <br />PARTS THEREOF, WITHIN THE CORPORATE LIMITS OF THE CITY OF LA <br />PORTE, AS SET OUT IN THIS ORDINANCE; PROVlDING A PENALTY OF A <br />FINE NOT TO EXCEED TWO HUNDRED DOLLARS ($200.00) FOR THE VlOLA- <br />TION OF THIS ORDINANCE; AND REPEALING ALL ORDINANCES ANDIOR <br />PARTS OF ORDINANCES -IN CONFLICT HEREWITH. <br /> <br />WHEREAS, Section 8 of Article 827s, Vernon's Penal Code of the <br /> <br />State of Texas, provides that whenever the governing body of the City shall de- <br /> <br />. <br /> <br />termine upon the basis of an. engineering and traffic investigation that any prima <br />facie speed therein set fortb.,is greater or less than is reasonable or safe un- <br /> <br />der the conditions found to exist at any intersection or other place or upon any <br /> <br />part of a street or highway within the City, ,taking into consideration the width <br /> <br />and condition of the pavement and other circumstances on such portion of <br /> <br />said, street or highway, as well as the usual traffic thereon, said governing <br />body may determine and declare a reasonable and safe prima facie speed <br /> <br />limit thereat or thereon by the passage of an orqinance, which shall be effec- <br /> <br />, . ' <br />tive when appropriate signs giving notice. thereof are erected at such intersection <br /> <br />or other place or part of the street or highwl;l-'y, now therefore, <br /> <br />BE IT ORDAlNED BY THE CITY CONlNlISSIQN OF THE crTY OF <br />LAPORTE, TEXAS, THAT:, <br /> <br />Section 1. Upon the basis of an engineering and traffic investigation <br />heretofore made as authorized by the previsions of Section 8 of Article 827s, <br /> <br />Vernon's Texas Penal Code, the following prima facie speed limits hereafter <br />indicated for vehicles are hereby determined and declared to be reasonable <br />and safe; and such speed limits are hereby fixed at the tate of speed indi- <br />cated for vehicles traveling upon the named streets and highways, or parts <br />thereof, described as follows: <br /> <br />. On State Highway 146-, North 10th Street, from the La Porte North <br />City Limit at a point 2,500 feet South of the centerline of the Houston Ship <br />Channel, to a 'point 2,600 feet .south of the centerline of the Houston Ship <br />Channel, a distance of approximately 0.019 mile, Forty-five (45) miles per <br />hour. <br />
