<br />repair, alter, change the size of, replace, substitute and remove pipelines from time to time (with structures, equip-
<br />ment, valv!ls, fittings and appurt,enant facili~iel!' whether above or belQ.w ground, ,f,rom time to time deemed by Grantee
<br />to be necessary or desi~able in connection with the use and convenient 'operat,io~ of any of said pipelines) for the trans-
<br />portation of gas, oil, petroleum products, or any other liquids, ga'ses or substances which can be transported through
<br />a pipeline, at a' location and on a route to be.selected by Grantee across, under, upon, oV,er and through the lands o,f
<br />Grantor or in which Grantor has an interest, situated in the County of Harris , State of

<br />The rights of way and'easements herein 'conveyed shall be
<br />ten (10) feet in width being more particularly shown on Exhibit
<br />A attached hereto' and made a part hereof.

<br />The rights of way and easements herein conveyed shall be
<br />for the use and benefit of all publi~ utilities.

<br />The Grantee shall have all other rights and benefits necessary or convenient for the full enjoyment or use of
<br />the rights herein granted, including, but without limiting the same to, the right of ingress and egress over and across
<br />said lands and said right-of-way and easement, and the right from' time to time to cut and remove all trees, under-
<br />growth and other obstructions that may injure said pipelines and appurtenances or interfere with the construction,
<br />operation, maintenance, repair, change, replacement or removal t,hereof. The Grantee shall have the right to assign
<br />this grant in whole or in part,
<br />
<br />Gr~ntor shall have the right to use and enjoy the surface of said right-of-way and easement hereinaoove dell.-,
<br />cribed provided such use and enjoyment shall not interfere with the use thereof by Grantee for the purposes for which
<br />said right-of-way and easement is granted, and provided further that Grantor shall not erect or construct, nor permit
<br />the erection or construction of, any houses, structures, lakes, ponds, dams or other obstructions on, over, across
<br />or within said right-of-way and easement or that will interfere with any of the rights herein granted to Grantee,
<br />
<br />TO'HAVE AND TO HOLD the said right-of-way and easement unto Grantee, its successors and assigns, until
<br />a pipeline is constructed hereunder and so long thereafter as a pipeline is located thereon, and the undersigned hereby
<br />bind themselves, their heirs, executors and administrators, successors and assigns. to warrant and forever defend
<br />all and singular said premises unto Grantee, its successors and assigns, against every p~rson whomsoever claiming
<br />or to claim the same or any part thereof. '

<br />It ip agreed that this grant covers all the agreements between the parties and no representations or state-
<br />ments, verba~ or written, have been made, modifying, adding to, or changing the terms of this agreement. The terms
<br />and provisions hereof shall inure to the benefit of and be binding upon Grantor and Grantee and their respective heirs.
