<br />. <br /> <br />. <br /> <br />ORDINANCE NO. 705-D <br /> <br />~- <br />":",,,~ <br /> <br />AN ORDINANCE AME~DING ORDINANCE NO. 705 (AN ORDINANCE PROVIDING <br />RULES AND REGULA~IONS GOVERNING THE PLATTING OR RE-PLATTING OF <br />LAND IN THE SUBDIVISIONS IN THE CITY OF LA PORTE AND WITHIN THE <br />EXTRATERRITORIAL JURISDICTION OF THE CITY OF LA PORTE); AND <br />PROVIDING THAT ANY PERSON VIOLATING THE TERMS OF THIS ORDINANCE <br />SHALL BE DEEMED GUILTY OF A MISDEMEANOR AND UPON CONVICTION SHALL <br />BE FINED IN ANY SUM NOT LESS THAN TEN DOLLARS ($10.00) NOR MORE <br />THAN TWO HUNDRED DOLLARS ($200.00) AND EACH DAY OF VIOLATION <br />SHALL BE DEEMED A SEPARATE OFFENSE. <br /> <br />BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF LA PORTE: <br /> <br />Section 1. Section 11~5 of Ordinance 705.is hereby <br /> <br />amended t:o read as follows : <br /> <br />41 <br /> <br />"11.05 STRE:E:T LIGHTING. Street lighting at all street <br />intersect:ions and cul-de-sacs shall conform to the latest edition <br />of the Illuminating Engineering Society Handbook. Round tapered <br />standards with bracket arms shall be used. Lighting levels are <br />reconunended for very light tra'ffic, med.:j..um traffic on feeder <br />streets, and heavy traffic on thoroughfares. Street lighting <br />shall be provided upon all other streets of the subdivision, but <br />need not conform to the light intensity requirements of the said <br />Illuminat:ing Engineering Society Handbook, at points within the <br />subdivision other than street intersections and cul-de-sacs. <br /> <br />. <br /> <br />"It is the present policy of the Housto~, Lighting and <br />Power Company. to accept orders only from the' City for electric <br />street li.ghts to be installed within the city limits. Accord- <br />ingly, the developer or owner of the land to be subdivided, <br />or land \<';rhich 'has been subdivided, within the city limits, <br />shall make application for electric street lights to the City. <br />Such application shall be accompanied by a copy of the plat <br />of the su.bdivision" showing thereon the requested location(s) <br />of the electric street li~hts. The application shall also be <br />accompanied by the developer's or owner's payment to the City <br />of the sum of One Hundred Fifty Dollars ($150.00) for each <br />requested electric street light, to reimburse the City for <br />the operational cost of the' street light for the first five <br />(5) years. Upon approval of the location of the street light <br />locations by the City Engineer~ the City will place an order <br />for the installation of' the electric street lights with Houston <br />Lighti~g & Power Company. <br /> <br />"Owners or developers of land situated outside of the <br />city limits may continue. to deal directly with Houston Light- <br />ing & Power Company for street light installation." <br /> <br />Section 2. .Penal ties. Any person violating this <br /> <br />ordinance or anh portion thereof shall upon conviction be <br />guilty of a miseameanor and shall be fined not less than Ten <br />Dollars ($lO.OO) nor more than Two Hu.ndred Dollars ($200.00) and <br /> <br />each q,ay that such violation continues shall constitute a <br />separate offense and be punishable accordingly. <br />Section 3. This Ordinance shall take effect and be <br /> <br />~.~. <br /> <br />in force from and after its passage and approval and pUblica- <br /> <br />tion as required by law. <br />
