<br />. <br /> <br />e <br /> <br />ORDINANCE NO. 705-H <br /> <br />. <br /> <br />AN ORDINANCE AMENDING ORDINANCE NO. 705 (AN ORDINANCE PROVIDING, <br />RULES AND REGULATIONS GOVERNING THE PLATTING OR RE-PLATTING OF <br />LAND IN ~~HE SUBDIVISIONS IN THE CITY OF LA PORTE 'AND WITHIN THE' <br />EXTRATER~ITORIAL JURISDICTION OF THE CITY OF LA 'PORTE); AND <br />PROVIDING THAT ANY PERSON VIOLATING THE TERMS OF THIS ORDINANCE <br />SHALL BE DEEMED GUILTY, OF A MISDEMEANOR AND UPON CONVICTION <br />SHALL BE FINED IN ANY SUM NOT LESS THAN TEN DOLLARS ($10.00) <br />NOR MORE THAN TWO HUNDRED DOLLARS ($200.00) AND EACH DAY OF <br />VIOLATION SHALL BE DEEMED A SEPARATE OFFENSE; AND PROVIDING AN <br />EFFECTIVE: DATE HEREOF. <br /> <br />BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF LA PORTE: <br /> <br />Section 1. Section 5.09, Park, Playground and School <br /> <br />Sites, Paragraph 1, Sub-paragraphs (a), (b), and (c), of <br />City of La Porte Ordinance No. 705, is hereby amended, and <br /> <br />shall hereafter read as follows, to-wit: <br /> <br />. <br /> <br />"1. Parks and Playgrounds: <br /> <br />A subdivider shall be required to dedicate a suitable <br />site for park purposes, or to make a deposit to the <br />City in lieu thereof, for residential subdivision <br />which shall include all zoning districts for family <br />residences whether single or multi-family types, in <br />accordance with the following regulations: <br /> <br />. <br /> <br />(a) On any residential subdivision, the subdivider, <br />at the discretion of the planning and zoning <br />commission, shall be required to dedicate either <br />five per cent (5%) of the total area of the sub- <br />division for park purposes, or its equivalent in <br />money of the fair market value of the undeveloped <br />land. If required, the subdivider shall deposit <br />in the City's park development fund money equiva- <br />lent to the fair market value of the undeveloped <br />land five per cent (5%) of the area within the <br />subdivision for the development of the closest <br />park to the subdivider. If the planning and <br />zoning commission should require land, the <br />location of such land shall be designated by the <br />planning and zoning commission upon recommen- <br />dation from the director of parks and recreation <br />under the following stipulations: <br /> <br />. <br /> <br />(1) The area of the park to be dedicated shall be <br />measured and calculated to the center line of <br />any ~treet within the subdivision which bounds <br />the park area. <br /> <br />(2) When a subdivision is to be developed in <br />stages, or by units, so that the actual <br />platting of the park area to be dedicated is <br />not done until the second or later stages, <br />the subdividers shall complete and deliver to <br />the planning and zoning commission with the <br />final plat of the first stage of the subdi- <br />vision a form furnished by the planning and <br />zoning commission which shall provide for <br />the dedication of the park area, or the <br />equivalent amount of money. <br />
