<br />-~~ <br /> <br />-.- <br /> <br />e..~ <br /> <br />....,~, <br /> <br />."-:;; <br /> <br />. <br /> <br />. <br /> <br />ORDINANCE NO. <br /> <br />7~Y <br /> <br />AN ORDINANCE VACATING1 ABANDONING AND CLOSING <br />THE ALLEY LYING WITHIN BLOCK ONE HUNDRED FIFTY- <br />S~VEN (157) IN THE, TOWN OF .LA PORTE1 HARRIS <br />COUNTY I TEXAS <br /> <br />WHEREAS, the said alley in Block One Hundred Fifty- <br />seven (157) has never been opened or used as a public thorough- <br />fare, and the public utilities now making use of such alley~ have <br />all given their written consent for its closing; and <br />WHEREAS, the City Commission of the City of La Porte <br />has determined and does hereby findl determine and declare that <br />the said alley is not suitable, needed, or beneficial to the <br /> <br />public as a public alleYI and should be vacated, abandoned and <br />permanently closed: <br /> <br />NOW I THEREFORE, BE IT ORDAINED BY THE CITY <br />COMMISSION OF THE CITY OF LA PORTE1 TEXAS1 THAT: <br /> <br />Section 1. The alley located in Block, One Hundred <br />Fifty-seven (157) of the Town of La Porte, Harris County, Texasl <br />is hereby permanently vacated, abandoned and closed by the City <br />of La Porte; provided, however, that the City of La Porte expressly <br />reserves an easement~ and the right of ingress and egress to repair, <br />maintain, replace, and remove the existing sanitary sewer line <br />And Water Line <br />located within said alley, until such time as said existing sewer <br />... and Wa tE~.r Line <br />line is no longer used by any property owner in Block One Hundred <br />Fifty-seven (157), Town of La Porte, Harris County, Texas, and the <br />said property owners have made written request to the City Commis- <br />sion of the City of La Porte for the abandonment of said sewer line, <br />and said Water Line, <br />at which time this easement herein retained shall terminate. <br /> <br />Section 2.
