<br />. <br /> <br />. <br /> <br />. <br /> <br />. <br /> <br />Cb) That said City Commission, after having duly ad- <br />vertised for bids in the mapner and for the time as required by <br />law and the Charter of said City, did award a contract for the <br />construction of said improvements to Gulf Bitulithic Company, a <br />Di vision of Warren Brothers /. Company, it having been found to be <br />the lowest responsible bidder for such improvements, and said <br />contract has heretofore been duly executed and completed by said <br />City and said Gulf Bitulithic Company, a Division of Warren <br />Brothers Company, the execution of which contractvas duly authorized <br />by Ordinance No. 760 enacted bY$id City Commission on March 6, 1967, <br />and the Performance and Payment Bonds required by law and said con- <br />tract have been properly furnished by said Gulf Bitulithic Company, <br />and approved and accepted by said City Commission, and an appro- <br />priation of available funds has been duly made by Ordinance of said <br />City Commission to cover the City's portion of the costs of said <br />improvements, all in full compliance with the requirements of the <br />law and the Charter of said City. . <br /> <br />(c) That the City Engineer, and Director, Department of <br />Public Works, as instructed by the City Commission, prepared and <br />filed with the City Commission a proper statement of the estimates <br />of the costs of the improvements of said streets and units and of <br />the estimates of the amounts per front foot proposed to .be assessed <br />against the property abutting thereupon and the owners thereof and <br />of other costs and matters relating thereto, all as required by law, <br />which statement of estimates was received, examined and approved <br />by the City Commission by Ordinance 771 enacted on June 12, 1967, <br />and further said City Commission did by said Ordinance No. 771 <br />order and set a hearing to be held at 2:00 o'clock P.M. on the 12th <br />day of July, 1967, at the City Commissio~r Chambers at theCity Hall <br />of and in the City of La Porte, Texas, for the real and true owners <br />of the properties abutting upon said streets or Units within the <br />limits above defined, and for all others owning or claiming ,any <br />interest in, or otherwise interested in said properties or any of <br />said matters as to the assessments and amounts proposed to be <br />assessed against each parcel of said abutting property and the <br />owners thereof and as to the special benefits to accr~e to said <br />abutting properties and, the owners thereof by virtue of said im- <br />provements, if any, or concerning any error in validity, irregular- <br />ity or deficiency in any proceedings or contract concerning same, <br />at which time all persons, firms, corporations, estates, owning or <br />claiming any such abutting property, their agents, or attorneys, or <br />any persons interested in said proceedings, might appear in person <br />or by counsel and offer evidence. <br /> <br />Cd) That said City Commission did further by said Ordinance <br />No. 771 order and direct the City Clerk of said City to give notice <br />o~ said hearing in the manner and ~or the time as required by the <br />law and the Charter of said City; and said notice, as so ordered <br />and directed and as required by law governing these proceedings, <br />has been properly and duly given, in the form and for the time as <br />required by said law, by the publication thereof at least three (3) <br />times before the date of said hearing in the La Porte - Bayshore <br />Sun, a newspaper published in the City of La Porte, Texas, the <br />first publication being made at least twenty-one (21) days before <br />the date of said hering, the dates of such publications being June <br />l~, 1967, June 22, 1967 and June 29, 1967, and further by the City <br />Clerk giving additional written notice of said hearing by depositing <br />in the United States mail, at least fourteen (14) days before the <br />date of said hearing, written notice of such hearing postage pre- <br />paid, in an envelope addressed to the owners of the respective <br /> <br />. <br /> <br />. <br /> <br />- 4 - <br />
