. e Ordinance No. 780-Z, Page 2. - Section 4. The City Commission of the City of La Porte hereby accepts the recommendation of the City of La Porte Planning and Zoning Commission, and a Special Use Permit, subject to the terms and conditions of this Ordinance, is hereby granted for Light Industrial. The zoning classifi- cation of said parcel of land shall, hereafter be "District C --Apartment and Commercial District, with Special Use Permit for Light Industrial." The qescription of said parcel of land hereby granted a Special Use Permit is as follows, to-wit: Outlot One :(1), Nebraska Syndicate Subdivision, City of La Porte, Harris County, Texas. . Section 5. The Special Use Permit hereby granted shall be subject to ,the following terms and conditions, to-wit: . (1) Said tract or parcel of land shall be used for a lime processing facility, at which lime shall be received in sealed rail hopper cars at a private siding situated on said plant site, after which it shall be con- verted to liquefied lime before being placed upon trucks for delivery from the plant site to users. (2) The granting and the continuation of this Special Use Permit shall be and remain subject to the granting, and continuation in good standing, of necessary permits from any 'and all local, state and federal agencies having jurisdiction over environmental matters, including, but. not limited to, the Environ- mental Protection Agency, the Texas Water Quality Board, the Texas Air Control Board, and 'the Harris County Pollution Control Departmen t . (3) Prior to the issuance of a building permit for said plant facilities by the City of La Porte, the plans and specifications shall be subject to review by the City Engineer of the City of La Porte, who shall have the right to require any modifications, additions or deletions, which in his opinion are neces- sary to conform the construction and operation of said lime plant to the public health, safety, and convenience of the citizens of the City of La Porte. .. (4) The granting of this Special Use Permit by the City Commission of the City of La Porte shall not'be deemed to be a commitment by the City of La Porte to furnish treated domestic water for other than usual domestic and sani- tation purposes, to said plant site. ~
