. , -~ e e .- ORDINANCE NO. 88-9 AN ORDINANCE AUTHORIZING AND APPROVING A CONTRACT BY AND BETWEEN CITY OF LAPORTE AND CITY OF SHOREACRES mR THE PROVISION OF FIRE PROTECTION 'I'D CITY OF SHOREACRES BY CITY OF LAPORTE DESIGNATING TIlE CITY OF LAPORTE AS THE AGENCY FOR DELIVERY OF FIRE PROTECTION TO CITY OF SHOREACRES; CON- TAINING A SEVERABILITY CLAUSE WHEREAS, pursuant to the Interlocal Cooperation Act, municipalities may, fram time to time, enter contracts beneficial to both, and WHEREAS, it is deemed in best interest of the City of Shoreacres to en- ter a contract whereby City of laPorte will provide fire protection ser- vices to City of Shoreacres, NOW THEREFORE: BE IT ORJ:l.l\INED BY THE CITY COUNCIL OF CITY OF' SHORE'ACRE:S: SECTION ONE. The City Council of City of Shoreacres does hereby approve fonn and substance of that certain contract for the provision of fire pro- tection services, a facsimile of which is annexed hereto, designated ex- hibit "A" hereof and incorporated herein for all purposes. SECTION 1WJ. The Mayor of City of Shoreacres is hereby authorized and directed to execute and the City Secretary to attest the annexed contract documents and counterparts thereof for and on behalf of Ci ty of Shore- acres and as an act and deed thereof. SECTION THREE. The City of laPorte is hereby designated as the official agent of City of Shoreacres for the provision and delivery of fire pro- tection accot~ing to the terms of the annexed contract. SECTION FOUR. The City Council hereby declares its intention that if any section or subsection of this ordinance or the contract it incorporates should be declared illegal or unconstitutional by a court of competent jurisdiction, the balance and remainder of the ordinance and contract shall not be affected thereby and shall be of full force and effect.
