<br />'ORDINANCE NO. <br /> <br />1624 <br /> <br />, <br /> <br />AN ORDINANCE DETERMINNG THE NECESSITY TO CONDEMN A <br />TRACT OF LAND FOR SANITARY LANDFILL PURPOSES AND <br />AUTHORIZING SPECIAL COUNSEL TO THE CITY TO INSTITUTE <br />AND PURSUE CONDEMNATION PROCEEDINGS FOR THE ACQUISI- <br />TION THEREOF; FINDING COMPLIANCE WITH THE OPEN MEET- <br />INGS LAW; AND PROVIDING FOR THE EFFECTIVE DATE HEREOF. <br /> <br />WHEREAS, the City has obtained a permit to operate a sanitary landfill upon the <br /> <br />tract of land described hereafter; and, <br /> <br />WHEREAS, the City has negotiated with the owner of the land for the purchase <br />thereof by the City and the owner has rejected all offers to purchase; and, <br />WHEREAS, the solid waste disposal needs of the City require that it proceed with <br /> <br />the acquisition, establishment and operation of a sanitary landfill upon such land; NOW <br /> <br />THEREFORE, <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LA PORTE: <br /> <br />Section 1. The City Council of the City of La Porte hereby finds, determines and <br />declares that there is a public necessity for the City of La Porte to acquire the tract of land <br />described by Exhibit A to this Ordinance for sanitary landfill purposes. <br />Section 2. Special Counsel to the City of La Porte, the law firm of Sears and <br /> <br />Burns, is authorized to institute and pursue condemnation proceedings against the owners of <br /> <br />interests in such land in order to acquire such land for use as a sanitary landfill. <br /> <br />Seetin 3. The City Council officially finds, determines, recites and declares that <br /> <br />a sufficient written notice of the date, hour, place and subject of this meeting of the City <br /> <br />Council was posted at a place convenient to the public at the City Hall of the City for the <br /> <br />time required by law preceding this meeting, as required by the Open Meetings law, Article <br /> <br />6252-17, Texas Revised Civil Statutes Annotated; and that this meeting has been open to the <br /> <br />public as required by law at all times during which this ordinance and the subject matter <br /> <br />thereof has been discussed, considered and formally acted upon. The City Council further <br /> <br />ratifies, approves and confirms such written notice and the contents and posting thereof. <br /> <br />Section 4.
