<br />. . <br /> <br />ORDINANCE NO. 1625 <br /> <br />AN ORDINANCE RECITING THE CIRCUMSTANCES OF THE HOUSTON LIGHTING & <br />POWER COMPANY (HL&P) STATEMENT OF INTENT TO CHANGE ELECTRIC RATES1 <br />SUSPENDING THE SCHEDULE OF RATES OF HL&P FOR A PERIOD OF NINETY (90) <br />DAYS FROM THE EFFECTIVE DATE THEREOF1 AND PROVIDING AN EFFECTIVE <br />DATE FOR THIS ORDINANCE. <br /> <br />WHEREAS, on November 23, 1988, the Houston Lighting & Power <br />Company (HL&P) filed a Statement of Intent to change its rates for <br />electric service within the City of La Porte and has requested that <br /> <br />said changes become effective on December 29, 19881 and <br /> <br />WHEREAS, HL&P has filed revised Tariff Schedules together with <br />statements specifying in detail each proposed change, a rate filing <br /> <br />package, and supporting testimonY1 and <br /> <br />WHEREAS, Section l7(a) of the Public Utility Regulatory Act, <br /> <br />Article 1446c, Texas Revised Civil Statutes, gives the governing <br /> <br />body of each municipality exclusive original jurisdiction over <br /> <br />electric rates within its municipal boundaries1 and <br /> <br />WHEREAS, Secction 43(d) of the Public Utility Regulatory Act <br /> <br />authorizes the governing body of any municipality acting as a <br /> <br />Regulatory Authority to suspend the operation of any proposed change <br />in rates for a period not to exceed 90 days beyond the date on which <br /> <br />the scheduled rates would otherwise go into effect, which period may <br /> <br />be further extended for an additional 150 days by the Texas Public <br />Utility Commission1 and <br /> <br />WHEREAS, HL&P's proposed rate changes and the detailed material <br /> <br />supporting those changes require comprehensive evaluation and studY1 <br /> <br />now, therefore, <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LA PORTE: <br /> <br />Section 1. That the changes in rates for electric service <br /> <br />within the City of La Porte proposed by Houston Lighting & Power <br /> <br />Company to become effective on December 29, 1988, should be and are <br />suspended for a period of 90 days beyond said proposed effective <br />date, subject to an additional possible suspension of up to 150 days <br />beyond said date by the Texas Public Utility Commission. <br /> <br />Section 2. This Ordinance shall be effective immediately upon <br /> <br />its passage and approval. <br />
