<br />e <br /> <br />. <br /> <br />City of La Porte, Texas Ordinance No. 93- 1 956 <br /> <br />AN ORDINANCE FINDING AND DETERMINING THAT PUBliC <br />CONVENIENCE AND NECESSITY NO LONGER REQUIRE THE CONTINUED USE <br />OF CERTAIN DRAINAGE AND/OR UTILITY EASEMENTS LOCATED IN A FORTY <br />FOOT WIDE STRIP OF LAND IN HARRIS COUNTY, TEXAS, SAID STRIP OF LAND <br />BEING MORE FUlLY DESCRIBED IN THE BODY OF TIllS ORDINANCE; <br />VACATING AND ABANDONING SAID EASEMENTS TO HARRIS COUNTY, THE <br />ABUTfING PROPERTY OWNER, IN CONSIDERATION OF HARRIS COUNTY'S <br />RELOCATING THE CITY OF LA PORTE'S UTILITY LINES; CONTAINING <br />VARIOUS FINDINGS AND OTHER PROVISIONS RELATED TO THE SUBJECT; <br />AND DECLARING AN EMERGENCY. <br /> <br />* * * * * * * <br /> <br />WHEREAS, Harris County (the "County") has acquired a strip of land approximately <br />forty feet wide adjoining the east side of Underwood Road from Spencer Highway to <br />approximately 3300 feet North of Pasadena Boulevard; and <br />//' <br />WHEREAS, the County contemplates using said forty foot strip of land for the <br />widening of Underwood Road; and <br /> <br />WHEREAS, the City of La Porte, Texas (the "City") owns various utility and/or <br />drainage easements within said forty foot strip of land; and <br /> <br />WHEREAS, the widening of Underwood Road from 13th Street to Spencer Highway <br />will be a mutual benefit to the City and County; and <br /> <br />WHEREAS, the City desires to cooperate with the County in such widening; and <br /> <br />WHEREAS, the County has requested that the City vacate and abandon the City's <br />drainage and/or utility easements; and <br /> <br />WHEREAS, the City is willing to vacate and abandon the said drainage and/or <br />utility easements, upon the County's relocation of the City's utility lines; <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LA PORTE, <br />TEXAS: <br /> <br />Section 1. The City Council hereby adopts the findings set out in the preamble <br />hereof and finds and determines that public convenience and necessity no longer require the <br />continued use of the drainage and/or utility easements located in a forty foot wide strip of <br />land described by metes and bounds in Exhibit "A", attached hereto and made a part hereof; <br />and said drainage and/or utility easements are hereby vacated and abandoned in <br />consideration of the County's relocating the City's utility lines in the Underwood Road right- <br />of-way according to the plans and specifications for Harris County Job # PIN <br />
