<br />. <br /> <br />. <br /> <br />ORDINANCE NO. 1676 <br /> <br />Page 2 <br /> <br />further approval of council for budgeted items not exceeding <br />$5,000.00. All contracts for expenditures involving more than <br />$5,000.00 must be expressly approved in advance by council. If <br />the competitive sealed bidding requirement applys to the <br />contract, the contract must be awarded to the lowest <br />responsible bidder. Councilor the city manager, in such cases <br />as he is authorized to contract for the city, may reject any <br />and all bids. If the competitive sealed proposals requirement <br />applys to the contract, the contract must be awarded to the <br />responsible offeror whose proposal is determined to be the most <br />advantageous to the city considering the relative importance of <br />price and the other evaluation factors included in the request <br />for proposals. Council by ordinance may increase the $5,000.00 <br />limitation herein provided to conform to subsequent increases <br />authorized by state law. Contracts for professional services <br />for which bidding is prohibited by state law shall not be let <br />on competitive bids. Procurement of architectural or <br />engineering services shall be in accordance with the <br />Professional Services Procurement Act. In the event of <br />conflict between any provision of this section and state law, <br />state law shall prevail." <br /> <br />The ballot for said charter amendment election shall conform to <br /> <br />Section 52.072 and Section 52.073, TexaS Election Code. The wording <br />of the proposition that is to appear on the ballot shall be "THE <br /> <br />AMENDMENT OF SECTION 5.02, 'PURCHASE PROCEDURE,' OF THE HOME RULE <br /> <br />CHARTER OF THE CITY OF LAPORTE." The words "FOR" and, below it, <br /> <br />"AGAINST" s~all be printed on the ballot to the left of the <br /> <br />proposition. <br /> <br />Section 2. Said election shall be held at each of the <br /> <br />following voting places within said City, and the following named <br /> <br />persons are hereby appointed as officers of said election, to-wit: <br /> <br />Election Precinct i I <br /> <br />Polling Place: <br /> <br />Lomax Elementary School <br />10615 North Avenue "L" <br />La Porte, Texas 77571 <br /> <br />Boundaries: <br /> <br />BEGINNING at the intersection of the Southern Pacific Railroad <br />tracks and Spencer Highway (West Main Street)~ <br /> <br />THENCE westerly along Spencer Highway (West Main Street) to <br />Big Island Slough~ <br /> <br />THENCE north to north boundary of Creekmont Subdivision~ <br /> <br />THENCE west along north boundary of Creekmont Subdivision to <br />Underwood Road~ <br /> <br />THENCE north along Underwood Road to the Southern Pacific <br />Railroad tracks~ <br /> <br />THENCE southeasterly along the Southern Pacific Railroad <br />tracks, 'following a curve to the South, and continuing in a <br />Southerly direction along the Southern Pacific Railroad to <br />Spencer Highway (West Main Street). <br />
