The City Council of the City of La Porte hereby <br />adopts the "Drug and Alcohol Abuse Policy," and the "Drug and <br />Alcohol Abuse Program Procedures," in form attached hereto as <br />Exhibit nA", incorporated by reference herein, and made a part <br />hereof for all purposes. <br />Section 3. All ordinances in conflict herewith are hereby <br />repealed, to the extent of such conflict only. Specifically, and <br />without limiting the generality of the foregoing, the City of La <br />Porte Personnel Policy Manual, as amended, as heretofore adopted by <br />the City Council of the City of La Porte, is hereby amended to <br />include the "Drug and Alcohol Abuse Policy," and the "Drug and <br />Alcohol Abuse Program Procedures," as adopted by this Ordinance. In <br />the event of any conflict between the terms and provisions of the <br />City of La Porte Personnel policy Manual, as amended, as heretofore <br />adopted by the City Council of the City of La Porte, and the terms <br />and provisions of this Ordinance, and the terms and provisions of <br />the policy and procedures adopted hereby, the terms and provisions <br />of this Ordinance and the policy and procedures adopted hereby, <br />shall prevail, to the extent of such conflict. <br />Section 4. If any provisions, section, exception, subsection, <br />paragraph, sentence, clause or phrase of this ordinance, or the <br />terms and provisions of the policy and procedures adopted hereby, or <br />the application of same to any person or set of circumstances, shall <br />for any reason be held unconstitutional, void or invalid, such <br />invalidity shall not affect the validity of the remaining provisions <br />of this ordinance or their application to other persons or sets of <br />circumstances and to this end all provisions of this ordinance and <br />the policy and procedures adopted hereby are declared to be <br />severable. <br />Section 5. The City Council officially finds, determines, <br />recites and declares that a sufficient written notice of the date, <br />hour, place and subject of this meeting of the City Council was <br />posted at a place convenient to the public at the City Hall of the <br />City for the time required by law preceding this meeting, as <br />
